EDD agrees to pay more than 100,000 claims stuck in pending status

A claimant or employer can appeal the outcome of an ESD determination to allow or deny unemployment insurance benefits. The chart shows the number of appeal requests received in the month and the status of the requests as of the chart publication data. Statuses include:

No action taken: The request has been reviewed by staff who close the work item with no further action because the request is a duplicate, the request is moot because the requested relief has already been granted, or the claimant is not an aggrieved party.

Pending: The number of appeal requests received by the department that are currently being reviewed for transmittal to OAH or to redetermine the department’s original decision.

Redetermined: The request has been reviewed by staff and the outcome has been redetermined to allow benefits based on new information.

Sent to OAH: A formal request for an appeal hearing is sent by ESD staff to the Office of Administrative Hearings . This happens after staff review the appeal and determine that the denial of benefits still stands or any of the relief requested in the appeal was not granted and therefore the claimant is an aggrieved party.

Why Havent I Received My Unemployment Benefits

With no help in sight, people like Harris are turning to elected officials, lawyers, and even social media for help. Harris is part of the Unofficial California Unemployment Help Facebook group, which has drawn more than 56,000 members since it was started in March.

When asked via email what is causing the delays, the California EDD cited unprecedented demand for unemployment benefits. The EDD says it has processed 11.9 million combined claims for the regular unemployment insurance program, as well as the Pandemic Unemployment Assistance program.

Many states operate unemployment systems that are sorely out of date or didnt have the staff to handle this deluge of applications. The states are catching up, but if there is anything wrong with your application, you could get lost in the mix, says Andrew Stettner, a senior fellow at the progressive, independent think tank The Century Foundation.

If your application gets flagged and your states unemployment agency lacks the resources to resolve your issue, you could get stuck, says Stettner, who has over 20 years of experience as an unemployment insurance policy advocate.

This is what happened to Mikaelah Pagan, who found her way to the same Facebook group as Harris. She says she filed for unemployment with the EDD the day she lost her food service job and waited four months to receive benefits.

Your State Unemployment Department Is Overwhelmed

Again according to reporting by The Washington Post, states are still behind on processing claims 14 months into the pandemic. Theyve simply been overwhelmed by volume this entire time. Not only were far more people unemployed but also people normally not eligible for benefits, such as self-employed workers, became eligible, adding to the demands on states systems.

I Am An Independent Contractor But I Am Only Partially Unemployed Can I Receive Unemployment Benefits

This depends. IDES must determine if your work as an independent contractor is covered under Illinois law, the amount of wages from covered employment you received in the past, and what you are earning currently. You will receive a weekly benefit amount based on your past covered wages. If your current weekly income does not exceed your weekly benefit amount, not including dependent allowance, you may be eligible for benefits for that week. If your income exceeds your weekly benefit amount, then you would not be eligible for benefits for that week.

Employees Or Independent Contractors

The classification of gig workers as independent contractors has led to another problem, now on full view in California. Uber and Lyft drivers who work another, traditional job, for which they receive a W-2, may get stuck in an arcane gap between regular unemployment and PUA. If, in any quarter over the previous 18 months, an applicant was paid $1,300 or more in W-2 wages, that employment, rather than any 1099 labor, would guide the benefits calculation. A worker who earned $50,000 on an app but only $5,000 from a catering stint could therefore miss out on hundreds of dollars per week in PUA.

This would not be a problem, of course, if platform work were enforced as W-2 employment, and on May 5, California filed suit against Uber and Lyft for inappropriately classifying massive numbers of drivers as independent contractors. Uber promised to fight the lawsuit Lyft said it looked forward to working with state officials. Administrators in Washington and Illinois are processing app-based workers for regular unemployment benefits on a case-by-case basis.Nick Demerice, a spokesperson for Washingtons Employment Security Department, said that some gig workers qualify in Washington for UI while some for PUA.

CJ Macklin, a representative for Lyft, would not address questions about records, but said that the federal government specifically identified gig workers and rideshare drivers as the type of people PUA funds are designed to help.

Answered: Number of calls answered by an agent from queues for the following claim center units: Intake, Adjudication and SAW Portal Help Desk.

High Call Volume Messages: Number of calls that receive the high-call volume message. Applications for UI have never been the easiest to navigate. That goes for both filers and administrators.

Your application might be flagged for further verification if you have a unique reason for losing your job, particularly if it might sound like you quit your position voluntarily. An example of that, Evermore says, could be someone whos recently been injured and had to quit their job operating heavy machinery. While it may appear like youve left voluntarily, theres actually more to the story that requires additional verification.

Any slightly more ambiguous answer to that question puts you in a category that gets extra review, Evermore says. And once the system says we cant automatically approve this because theres a flag, then it has to go to the adjudicator.

You Accidentally Answered A Question Incorrectly

According to reporting by ABC7 News in San Francisco, a confusingly worded question that many people answered incorrectly caused their California unemployment payments to get stuck on pending for weeks. The question asked people who were recertifying their qualification for benefits if there was any reason besides sickness or injury that they couldnt work.

Many people answered yes, because the pandemic was the reason they were out of work, but the system was set up assuming that people would answer no even if the pandemic was causing their unemployment. Their applications then got categorized as requiring an interview with an unemployment department representative, creating delays that can take weeks to resolve.

C Claims Adjudicators Determination As To Eligibility

For each week for which a claim for benefits is made, a claims adjudicator makes a determination as to the claimants eligibility.

An employer that has filed a sufficient Notice of Possible Ineligibility within the 10-day time limit is a party to such determination and is entitled to a notice of the determination and has the right to appeal it. The General Assembly, with the approval of the Governor, has allocated one million dollars to provide free legal assistance to small employers at Departmental hearings. To implement this provision, the Department contracted with a private law firm to provide this assistance. A contact telephone number is printed on determinations, decisions, etc., the appeals of which are covered by this program.

If no Notice of Possible Ineligibility or letter has been filed within the time limit, the employing unit is not a party to the determination.

An employer that has filed a sufficient and timely Notice of Possible Ineligibility alleging an issue of availability, disqualifying income, refusal of work or not unemployed becomes a party to any determination made with respect to the week for which the

Notice is received. Such employer will have appeal rights to the determination.

SEATTLE Thousands of people in the unemployment system have been waiting anxiously for federal relief to hit their bank accounts, and some are starting to see that this week.

It’s a hot topic in the Washington State Unemployment Support Group on Facebook. Some people in the group posted they started seeing payments from the Pandemic Emergency Unemployment Compensation fund as of Tuesday night.

This would fall in line with what the Washington Employment Security Department posted about PEUC payments.

The agency announced it had updated its computer system over the weekend of January 30 to start accepting the 11 additional weeks of benefits. The agency said if claimants have any pending PEUC payments, those would have begun processing over the weekend and could take two to three business days to be deposited in accounts.

The ESD also said that some people may receive a separate deposit for back payments depending on when weekly claims are submitted.

The agency said there could be some slowdowns as it processes large batches of information. The ESD’s busiest days fall on Sundays and Mondays, though people can submit a weekly claim up until the following Saturday.

A Notice of Possible Ineligibility or a letter containing the equivalent information should be mailed or faxed to the designated office within 10 days of the date of the notice of claim.

Failure to file a Notice within 10 days will result in a loss of party status and appeal rights.

Information contained on the Notice should include the names, addresses and telephone numbers of persons having personal knowledge of the facts and circumstances supporting the allegations.

The Notice must also meet the sufficiency requirements of 56 Ill. Adm. Code 2720.130 as follows:

  • A separate Notice should be sent for each claimant.
  • The allegations must be supported by material reasons or facts, rather than conclusions of law. .
  • If the employer alleges that the claimant is ineligible for benefits because of vacation pay, the employer must state the amount paid and must also designate the period to which such pay is allocated.
  • If the employer alleges that the claimant is not eligible for benefits because of a labor dispute, the employer must provide the Department with the name and social security number of each worker involved in the dispute within five days of the start of the period of the work stoppage due to such labor dispute.
  • If the Department determines that the Notice has not met the sufficiency requirements, the Notice will be returned with a description of the needed information.
