Some Unemployed In Nj Have Trouble Getting Benefits After State Said Issues Resolved

New Jersey claimants are receiving emails that their claims are not payable at this time after the state Labor Department switched people over from High Extended Benefits to the Pandemic Emergency Unemployment Compensation program.

The Labor Department claimed it would be a seamless transition for claimants switching to the Pandemic Emergency Unemployment Compensation program when the state triggered off of High Extended Benefits.

But John Flynn was one of the people the Labor Departments programming mistakenly excluded from the transition, and he was unable to certify as his claim showed up expired. After a week, the department said the issue had been resolved and claimants should continue certifying during open hours.

And while hes been able to certify, Flynn hasnt gotten his money in over two weeks. When he opens his claim, which is unpayable, it states in red letters that no action is needed on his behalf.

I hope I get backpay, but its more about the not knowing how long this will go, said Flynn, a writer for an ad agency who was laid off in March 2020. Im stuck in this claim not payable loop until Im not sure when.

The Labor Department believes all of these claimants can again certify for benefits without issues, according to spokeswoman Angela Delli-Santi.

Delli-Santi said the department is very sorry when this occurs and that staff tries to resolve the situation as quickly as possible.

How Do I Meet New Jersey Unemployment Eligibility Requirements

To qualify for unemployment benefits, you must meet the following initial New Jersey unemployment requirements:

How much money you earned in your base period.

Your base period is defined as the first four quarters out of the past five quarters before you file your initial New Jersey unemployment weekly claim. Your maximum benefit amount depends on how much money you earned in your base period. The maximum New Jersey unemployment amount in 2020 is $713. In your base period, you must have 20 weeks where you earned gross wages totaling at least $10,000. A base week is defined as one where you earned at least $200.

If you dont qualify for benefits using your base period wages, you may be able to qualify using an alternate base period. New Jersey has two possible alternate base periods. The first includes wages earned in the four most recently completed quarters before you file your claim. Efforts to develop modular technology for unemployment compensation systems are underway at the Department of Labor and the White Houses U.S. Digital Service.

The claimant experience pilot marks the Labor Departments first foray into product development for unemployment insurance, a benefit delivered at the state level, said Michele Evermore, deputy director for policy in the agencys Office of Unemployment Insurance Modernization.

New Jersey and Arkansas are participating. The tech being developed is for login processes with integrated identity verification.

The timeline is flexible, officials say, but the goal is to launch a minimum viable product around the end of March. The technology could potentially be adopted by states as they modernize.

It is a seriously ambitious undertaking for us to work with U.S. Digital Services to begin to figure out how federal tools can integrate with vastly different state systems.

When a minimum viable product is finished, itll first be tested to see if the new mobile-first, user-centered portal works before scaling, said Evermore.

Federal Enhanced Benefits Have Ended In New Jersey

The NJ DOL has confirmed that claimants on the PEUC, PUA, MEUC and FPUC programs will file/certify for benefits for the last time covering the week ending September 4, 2021.

Any active claims, with or without remaining balances, will expire after this date and any weeks after Sep 5th will NOT be paid. The only exception are retroactive payments for validated claims after a successful determination or appeal.

While there has been a lot of discussion around extending pandemic unemployment benefits, the Biden administration has confirmed that states will have to use already allocated stimulus funding to expand or extend traditional state unemployment programs.

The NJ DOL has not indicated that is planning to do so at this stage and Governor Murphy recent stated the following in recent remarks confirming this position:

Labor Commissioner Robert Asaro-Angelo told lawmakers other states have had the same problems with their unemployment systems as New Jersey.

Labor Commissioner Robert Asaro-Angelo took another beating from lawmakers during a budget hearing Wednesday, with legislators criticizing his department for taking so long to dole out jobless benefits during the pandemic.

Nearly every lawmaker on the Assembly Budget Committee shared a story of someone who has reached out to their office in need of help resolving an unemployment or disability claim. Assemblywoman Eliana Pintor-Marin , the committees chair, mentioned a constituent who is owed 36 weeks of unemployment benefits and has received a shutoff notice from PSE& G.

These are peoples livelihoods, said Pintor-Marin.

Asaro-Angelo, who appeared before the committee to answer questions about his departments budget request, defended the state workers who have processed nearly 2 million claims since April 2020 and explained to lawmakers why some people are still seeking help for their jobless claims more than two years after the pandemic led to massive job losses. The hearing lasted for three hours.

The commissioner discussed modernizations to the unemployment system applications were updated last week to be in plain language and apologized to the thousands of New Jerseyans who had to wait months to be paid.

The state Labor Department will no longer attempt to recover some overpaid unemployment payments after the federal government updated its guidance on pandemic-related unemployment benefits.

The change could affect more than 250,000 New Jerseyans who received extra unemployment benefits through no fault of their own, Labor spokeswoman Angela Delli-Santi said. The department is working through the details and will soon notify eligible claimants of the next steps, Delli-Santi said.

Unemployment skyrocketed during the first weeks of the pandemic, leaving the Labor Department flooded with hundreds of thousands of claims as businesses suddenly shuttered. Congress expanded unemployment benefits for workers who arent typically eligible, like gig workers and freelancers, but those guidelines changed dozens of times as new laws were passed.

About 130,000 residents have received letters from the state asking them to repay unemployment benefits paid in error, with the state blaming the strict federal guidelines. People who owe the Labor Department money typically cant receive more benefits until their claim is resolved.

Now, under the new guidance from the U.S. Department of Labor, there are five categories claimants must qualify for to see their overpayments waived, all related to pandemic benefits, like Pandemic Unemployment Assistance and Pandemic Emergency Unemployment Compensation .

How Do I Appeal A Decision

This appeal should be submitted within seven calendar days after your notice is received or within 10 calendar days of the mailing date marked on your determination notice.

State senators grilled Labor Commissioner Robert Asaro-Angelo during a contentious three-hour hearing Thursday, criticizing him over the states handling of the unemployment crisis at the height of the pandemic and questioning him about why they still hear from residents who say they havent received benefits they should have received long ago.

Senators relayed heartbreaking stories of the constituents theyve helped over the last two years. One listed the number of days residents said theyve been waiting for benefits 174 days, 203 days, 286 days. Another relayed the story of a woman who has waited so long, she has been married and had her name changed since she applied.

And they all expressed frustration and disappointment to the commissioner over the lack of in-person unemployment services nearly two years after COVID-19 led to a surge in jobless claims and a raft of complaints about the difficulty getting state employees on the phone to help.

I have someone whos still waiting for an appeals process a year later. I dont understand why it has to take 365 days, said state Sen. Teresa Ruiz . My community wants to go somewhere and see someone. Theyve been shut out of the process for two years I am asking you to please step up your game.

Having two people at a site wont cut it, Ruiz said.

It took until February but New Jersey Department of Labor finally completed programming for the 11-week benefits extension passed in late December. According to the agency the work got done ahead of schedule although officials were questioned why the state had a delay when New York and Connecticut had not.

The delay that left over 75,000 claimants without extended benefits was blamed on the last-minute federal action to continue benefits beyond the 26 December cutoff. States across the US experienced similar problems due to the bill passing so close to the benefits expiration and the subsequent hesitation to sign the legislation by former President Trump.

What If I Was Discharged For Misconduct

If you were fired or discharged from your job because you did something not in the best interests of your employer , you may be disqualified from collecting benefits. This kind of discharge is known as misconduct. The disqualification would begin the week the firing or suspension occurs and continue for the next five weeks. After the disqualification period ends, you may be able to collect benefits.

If you were fired for any reason that is serious enough to be considered a crime under the New Jersey Code of Criminal Justice, you may be disqualified from collecting benefits indefinitely. This is known as a gross misconduct discharge. To remove a gross misconduct disqualification, you must return to work for at least 4 weeks, earn 6 times your weekly benefit rate, and become unemployed through no fault of your own. In addition, the wages you earned with the employer who discharged you cannot be used to establish an unemployment claim or to remove a disqualification.

If you were fired, you will be scheduled for a claims examiner interview. The examiner will determine if you are entitled to benefits.
