Q. Last year, my husband and I filed our 2020 joint tax return before the implementation of the American Rescue Plan excluded $10,200 of unemployment payments from our yearly income. It was left to the IRS to adjust our return and we received a refund of taxes that we overpaid, based on our recalculated income level. So how can we get a copy of our revised tax return for 2020, since we didnt actually file an amended return, if we need it for a lender?

A. Youre correct in how the IRS handled the change in taxation of unemployment benefits.

Rather than requiring millions of taxpayers in your situation to file amended tax returns, the IRS took it upon itself to process the adjustments for change, which excluded up to $10,200 of unemployment compensation from taxation for 2020.

Instead of presenting a lender with the return, you should get your tax transcript from the agency, said Neil Becourtney, a certified public accountant and tax partner with CohnReznick in Holmdel.

The service, called Get Transcript, offers extensive information on the IRS website.

Becourtney said taxpayers can request a transcript both online and by mail.

Presumably a lender would accept from you a copy of your 2020 Form 1040 together with the transcript, which would differ by the excluded unemployment compensation, Becourtney said. It might behoove you to provide an explanation upfront regarding the difference in the figures.

What Else To Know About Unemployment Tax Refunds

The IRS has provided some information on its website about taxes and unemployment compensation. But were still unclear on the exact timeline for payments, which banks get direct deposits first or who to contact at the IRS if theres a problem with your refund.

Some states, but not all, are adopting the unemployment exemption for 2020 state income tax returns. Because some get full tax unemployment benefits and others dont, you might have to do some digging to see if the unemployment tax break will apply to your state income taxes. Reporting Unemployment Benefits At The Federal Level

For most states, you will receive Form 1099-G in the mail from your state unemployment office. Find out how you can obtain your 1099-G. On Form 1099-G:

  • In Box 1, you will see the total amount of unemployment benefits you received.
  • In Box 4, you will see the amount of federal income tax that was withheld.
  • In Box 11, you will see the amount of state income tax that was withheld.

You dont need to attach Form 1099-G to your Form 1040 or Form 1040-SR.

In certain states, you will not automatically be mailed a Form 1099-G. You will have to access your Form 1099-G online through your unemployment portal or call your state unemployment office to request that they mail your Form 1099-G. In other states, you will only be mailed a Form 1099-G if you selected that as your delivery preference.

States that will not mail 1099-Gs at all Connecticut, Indiana, Missouri, New Jersey, New York, and Wisconsin
States that will mail or electronically deliver 1099-Gs depending on which option you opted-into Florida, Illinois, Michigan, North Carolina, Rhode Island, Tennessee, and Utah

Iv Taxation Of Forgiven Paycheck Protection Program Loans

Section 12 of the Act provides a deduction for cancellation of debt income related to forgiven PPP loans made under § 1102 of the CARES Act. The deduction applies to the taxable year beginning January 1, 2020. PPP loan borrowers subject to the Massachusetts personal income tax, including Schedule C filers, certain partners in a partnership, and S corporation shareholders should not include in Massachusetts gross income the amount of a PPP loan forgiven under § 1106 of the CARES Act during the 2020 tax year.

The deduction parallels the federal exclusion for such income provided in the CARES Act. The Department previously stated, in TIR 20-9, that the amounts of COD income from such forgiven loans would be taxable under G.L. c. 62 because, for personal income tax purposes, Massachusetts generally follows the Internal Revenue Code as amended and in effect on January 1, 2005. The Act brings Massachusetts into conformity with the federal exclusion in the CARES Act. Consequently, this TIR supersedes TIR 20-9 as it relates to the inclusion of income from forgiven PPP loans for borrowers subject to the Massachusetts personal income tax. Taxpayers who have already filed their 2020 personal income tax returns and included forgiven PPP loans in Massachusetts gross income should file an amended return to exclude these amounts.

If you live in a state that has a state income tax, you may need to pay state income taxes on your unemployment benefits in addition to federal income taxes.

For states that dont have a state income tax or dont consider unemployment benefits taxable income, you wont need to pay state income taxes on your unemployment benefits. These are 17 states that dont tax unemployment benefits:

States that dont have any income taxes Alaska, Florida, Nevada, South Dakota, Texas, Washington, and Wyoming
States that only have income taxes for investment income New Hampshire and Tennessee

How And When Do I Get The Unemployment Tax Refund

People started seeing the refunds hit their bank accounts in May of this year. They continued through the summer.

The more complex returns took longer to process.

4 million refunds had been sent by the middle of July.

Those receiving the refunds by check mostly saw them after July 16.

More checks and direct deposits were sent at the end of July, and no payments were announced for Aug., Sept., or Oct.

Payments were sent in Nov. though, another 430,000 to be exact.

Another batch has been announced, but not when or how many.

Letters are sent to filers on behalf of the IRS to let them know a return was corrected.

The letters go out within 30 days of a correction.

There is no tool to track it, but you can check your tax transcript with your online account through the IRS.

Choose the federal tax option and the 2020 Account Transcript.

If you see a Refund issued then youll likely see a refund soon.

Filing An Initial Claim

What information do I need to file a new application?

When filing a new application, you will need the following information:

  • Your Social Security number
  • Full mailing address, including apartment or lot number, Zip Code and PO Box if you use one
  • A phone number where you can be reached during the day
  • The name and mailing address of your last employer, no matter how long you worked there
  • Note: Your paycheck stub or W-2 form usually contains this information
  • The date you began and stopped working for each employer and the reason you left each job for the last 18 months
  • The county in which you live
  • Your driver’s license number
  • If you are not a citizen or national of the United States, your employment authorization number and expiration date
  • If you were active duty military within the past 18 months, your DD-214, Member #4 form
  • If you were a federal employee, your Standard Form SF-50 or pay stub
  • Any separation, vacation, or holiday pay you have received or will receive in the future.

A record of your application will not be established unless you are told your claim has been accepted. If you are unable to complete your application, the information you have entered will be saved for 7 days from the date you began filing the claim so that you can complete it later and within 7 days.

Where To Find Your 1099

We will mail a paper copy of your 1099-G to the address we had on file for you on December 31, 2021.

We will start to mail out 1099-Gs in mid-January and will complete all mailings by January 31, 2022.

It is too late to change your address for the 1099-G mailing, but you can access your 1099-G online.

The total on your 1099-G includes any amounts that were withheld on your behalf, such as:

  • Overpayment offsets

Your 1099-G total does NOT include benefit payments that were processed in 2022, even if those payments were for weeks in 2021.

With most income, like wages, taxes are pay-as-you-go. With wages, you are expected to pay taxes on your income as you earn it. Tax Refunds On Unemployment Benefits Still Delayed For Thousands

The American Rescue Plan Act, a pandemic relief law, waived federal tax on up to $10,200 of unemployment benefits a person collected in 2020, a year in which the unemployment rate climbed higher than any time since the Great Depression.

However, many people eligible for the tax break had filed their annual tax returns before President Joe Biden signed the legislation on March 11.

That means they overpaid their federal tax bill and may qualify for a refund.

How To Use The Wheres My Refund Tool On The Irs Site

To check the status of your 2021 income tax refund using the IRS tracker tools, youll need to provide some personal information: your Social Security number or Individual Taxpayer Identification Number your filing status and your refund amount in whole dollars, which you can find on your tax return. Make sure its been at least 24 hours before you start tracking your refund.

Using the IRS tool Wheres My Refund, go to the Get Refund Status page, enter your personal data, then press Submit. If you entered your information correctly, youll be taken to a page that shows your refund status. If not, you may be asked to verify your personal tax data and try again. If all the information looks correct, youll need to enter the date you filed your taxes, along with whether you filed electronically or on paper.

Wheres My Refund has information on the most recent tax refund that the IRS has on file within the past two years, so if youre looking for return information from previous years youll need to check your IRS online account for more information. Through your own personalized account, youll be able to see the total amount you owe, your payment history, key information about your most recent tax return, notices youve received from the IRS and your address on file.

The Internal Revenue Service is delivering a fourth round of special tax refunds this week to 1.5 million taxpayers who paid taxes on unemployment benefits when they filed their 2020 tax returns. For this round, the average refund is $1,686 direct deposit refunds started going out Wednesday, and paper checks today.

Still waiting for your refund? An estimated 13 million taxpayers are due unemployment compensation tax refunds. Since May, the IRS has issued more than 8.7 million unemployment compensation tax refunds totaling $10 billion. That means more than 4 million taxpayers are still in line.

Why the special unemployment benefits tax refunds? In the March 11th Covid-relief American Rescue Plan, Congress made up to $10,200 of 2020 unemployment benefits nontaxable for individuals and married couples whose modified adjusted gross income was less than $150,000. Generally, unemployment benefits are taxable, including basic state benefits as well as the extra $600 weekly CARES Act federal pandemic benefits. The unemployment tax break was welcome news to many folks. The problem: A lot of taxpayers already had filed their 2020 tax return before Congress put in the retroactive tax break. Thats made things messy.

Unemployment Federal Tax Break

The latest COVID-19 relief bill , gives a federal tax break on unemployment benefits. This means that you dont have to pay federal tax on the first $10,200 of your unemployment benefits if your adjusted gross income is less than $150,000 in 2020. The $150,000 income limit is the same whether you are filing single or married.

For paper filers, the IRS published instructions on how to claim the unemployment tax break: New Exclusion of up to $10,200 of Unemployment Compensation. For online filers, the IRS has stated that tax software companies have updated their systems to reflect the unemployment federal tax break. If you file your taxes online and havent filed for 2020 yet, you may want to make sure your tax software is updated before filing your tax return.

If you filed your 2020 tax return before this new law change, the IRS is asking you not to file an amended return and not to take any additional steps. The IRS will automatically issue refunds starting in May and into the summer to those who qualify. If you claimed tax credits such as the Earned Income Tax Credit and Child Tax Credit , the IRS will also automatically issue refunds if you qualify for a higher amount because the tax break changed your income level.

If your state decides to give you a state tax break and you already filed your state return, you should check to see if you are newly eligible for any state tax credits.

What To Know About The Unemployment Tax Break

The first thing to know is that refunds would only go to taxpayers who received jobless benefits last year and paid taxes on that money before the provision in the American Rescue Plan Act of 2021. The tax break is for those who earned less than $150,000 in adjusted gross income and for unemployment insurance received during 2020. At this stage, unemployment compensation received this calendar year will be fully taxable on 2021 tax returns.

The $10,200 tax break is the amount of income exclusion for single filers, not the amount of the refund . The amount of the refund will vary per person depending on overall income, tax bracket and how much earnings came from unemployment benefits. So far, the refunds have averaged more than $1,600.

However, not everyone will receive a refund. The IRS can seize the refund to cover a past-due debt, such as unpaid federal or state taxes and child support. One way to know if a refund has been issued is to wait for the letter that the IRS is sending taxpayers whose returns are corrected. Those letters, issued within 30 days of the adjustment, will tell you if it resulted in a refund or if it was used to offset debt.

As the IRS continues issuing refunds, they will go out as a direct deposit if you provided bank account information on your 2020 tax return. A direct deposit amount will likely show up as IRS TREAS 310 TAXREF. Otherwise, the refund will be mailed as a paper check to whatever address the IRS has on hand.
