Q: How do I access the 1099-G tax form if I am the representative of a deceased claimant?
A: For the New York State Department of Labor to provide you with information belonging to a deceased unemployment insurance claimant, you must first show that you are legally authorized to receive this information. Authorization often comes from the New York State Surrogate Court, and may be one of the following:
- Appointment as an Executor
- Letters of Administration
- Appointment as a Voluntary Administrator
If the deceased claimant had no assets, or all property owned by the deceased claimant was owned in common with someone else, then no Executor or Administrator may have been appointed. You may choose one of the two methods below to get your 1099-G tax form:
- Online:The 1099-G form for calendar year 2021 will be available in your online account at labor.ny.gov/signin to download and print by mid-January 2022.
- If you do not have an online account with NYSDOL, you may call:1-888-209-8124 This is an automated phone line that allows you to request your 1099-G via U.S. Mail. The form will be mailed to the address we have on file for you.
Why Did I Get A 1099 G From The State
1099-G Form for State Tax Refunds, Credits or Offsets If the state issues you a refund, credit or offset of state or local income, that amount will be shown in Box 2 of your 1099-G form. Requesting A Duplicate 1099
If you do not receive your Form 1099-G by February 1, and you received unemployment benefits during the prior calendar year, you may request a duplicate 1099-G form by phone:
We cannot process requests for duplicate 1099-G forms until after February 1 because throughout January we are still mailing the original forms.
You do not need a paper copy of Form 1099-G to file your federal tax return the IRS only needs the total amount of benefits TWC paid you during the previous calendar year and the amount of taxes withheld.

Unexpected Ohio Unemployment 1099
We are hearing from some of our clients that have received a 1099-G form for 2020 from Ohio Department of Job & Family Services showing amounts in Box 1 Unemployment Compensation when they did not apply for unemployment in 2020. ODJFS is aware of this issue and has steps to correct the issue.
If you have received an Ohio 1099-G but you did not file for unemployment in 2020, you should visit unemployment.ohio.gov, click on the Report Identity Theft button, and complete the reporting form.Once you have completed the form to Report Identity Theft, ODJFS will issue a Corrected 1099-G showing the amount was not received.

In addition to completing the ODJFS reporting form, ODJFS strongly urges anyone who suspects they may be a victim of identity theft to take appropriate action to protect themselves. For example, individuals can visit annualcreditreport.com to see whether they may the victim of other types of identity theft. They also can visit OhioAttorneyGeneral.gov/IdentityTheft for educational resources for Ohioans who believe they may be the victim of identity theft.

Approximately 20000 Unemployed Ohio Workers Still Waiting For 1099
CLEVELAND Approximately 20,000 unemployed Ohio workers are still waiting for their 1099-G forms that are needed to file taxes this year because the forms were not generated by the states system, according to Bill Teets, Communications Director, Ohio Jobs and Family Services.
In a statement to News 5, Teets wrote, We do not yet know why, and our primary focus is on resolving that issue so we can get those 20,000 reissued. It is a matter of identifying, and then testing potential fixes, which weve been doing for several days now.
Weve received close to 1,000 requests to reissue 1099s and have been keeping current with those, according to Teets.
Cleveland resident Greg McPherson, 62, said he is one of the unemployed Ohio workers still waiting for a 1099-G.
Its disgusting, he said. This is our government, who is supposed to be working for the people and theyre treating the people like dirt.
News 5 Investigators reached out to ODJFS about the missing tax forms after McPherson and another News 5 viewer alerted us to the issue.
Its now March 3 and I still havent gotten my 1099 from our government, he said. Its not fair. Why arent they held accountable when we are?
McPherson said he has called the state to ask for a new 1099-G form, but, so far, no one has been able to help him.
Every time I called I always got a different answer. Nobodys on the same page, he said. Its incompetence at its finest.

If You Quit Your Job Because Of Covid
Generally, if you quit your job you are not eligible for unemployment benefits. However, under the new CARES Act Department of Labor guidelines, you may still qualify if you had to quit your job as a direct result of COVID-19. For example:
- You tested positive for or were diagnosed with COVID-19 and have now recovered. However, you now have health complications that make it impossible for you to do the core functions of your job, with or without a reasonable accommodation.

Will I lose my unemployment if I refuse to return to work or quit because I dont feel safe going back?The answer is maybe. While the CARES Act has some exceptions for workers directly impacted by COVID-19, if you are asked to return to work and refuse or quit you may lose your unemployment.
To keep your unemployment you would have to show just cause to refuse or quit. Simply saying that you are afraid to return to work isnt enough. To show just cause, you would need to prove that a reasonable person, under similar circumstances, would refuse or quit.

Those who received payments last year, including payments made in 2020 for weeks claimed in 2019, will receive a form, according to the state.
The form can be viewed by clicking on the “My 1099 ” button on the top right-hand corner of the page.

Some benefit recipients reported last week that dollar figures on their online form appeared incorrect.
“The UI system prematurely populated the 1099-G to claimants online accounts and they were not accurate,” said Kevin Kinnaird, spokesman for the Kentucky Labor Cabinet. “The staff removed the incorrect 1099s from the online system.”
Only correct forms were mailed out, Kinnaird said.
