What You Should Know About Free Cobra Coverage
Many people prefer to keep their employers health insurance coverage when they lose their jobs, although the cost is often prohibitive. Most employers pay a large portion of the cost to cover workers, but former employees who opt to extend their coverage using the federal COBRA law typically must pay the full premium plus a 2 percent administrative fee.
Thanks to the new law, employers are required to provide free COBRA coverage from April 1 through Sept. 30 to eligible former employees who lost their health care coverage because of involuntary termination or a reduction in hours, says financial planner and certified public accountant Kelley Long, consumer financial education advocate for the American Institute of CPAs. The employers cost will be offset by federal tax credits.
If youre eligible for other group health coverage through a spouse, new employer or Medicare, for example you wont qualify for free COBRA.
The intention is to help people who have no other options and would otherwise be uninsured because they cant afford COBRA, Long says.
There will be a special enrollment window at the end of September to allow people with COBRA to switch to an ACA plan, McDermott says.

Businesses Are Cutting Employee Hours To Avoid Covering Employees
Opponents of Obamacare claimed the legislation would destroy jobs. The number of full-time jobs has gone up in recent years, but there are still reports of businesses cutting hours from employee schedules.
Business with 50 or more full-time employees must offer insurance or make payments to cover healthcare expenses for employees. By reducing hours, businesses are able to get by the 30-hour-per-week definition of a full-time employee.

What Youll Pay Each Month
The unemployment-based subsidies will cover the full cost of the benchmark plan. So youll have access to two Silver plans that have no premium, and youll likely have access to a variety of Bronze plans and possibly some Gold plans that have no premium.
If you pick a plan thats more expensive than the benchmark plan, including the higher-cost Silver plans, youll pay at least some premium each month.
If youre in a state that has additional state-mandated benefits that arent covered by premium subsidies, you may find that you have to pay at least a dollar or two each month in premiums, regardless of which plan you select.
Alternatives To Obamacare And Cobra
If you are sticking with COBRA coverage from a prior job, be aware that your full premium payments under the American Rescue Plan end September 30th. If you do not anticipate getting a job with health care benefits by that date, you may want to sign up for Obamacare, and you should be aware that the special enrollment period for it ends May 15th. If you prefer to get onto an ACA plan, make sure you apply by that time, or prepare for what youll do between the time that COBRA coverage stops and the next open enrollment period in November begins.
Neither has an enrollment period you can apply and be approved at any time. If your state is among those that approved the expansion of Medicaid availability, you may qualify for a Medicaid plan even if youve never signed up for it before.
Medicaid coverages vary by state. In the coming months, some states that didnt previously adopt the optional Medicaid expansion element of the ACA may consider expanding their Medicaid coverage because of funds allocated in the American Rescue Plan.
Cobra Is No Longer Unaffordable
People who have lost their job and the health insurance that went with it can turn to COBRA, a federal program that allows staying on the same plan, but only by paying its full cost including the part the employer previously paid. This is so expensive that many people opt not to use this option. With the stimulus package, also known as the American Rescue Plan, thats no longer the case.
If you are eligible for COBRA currently, you may qualify to have your whole premium covered by another provision in the package, until September 31st. While it may still make sense to switch to an ACA plan especially if you now qualify for free insurance premiums through the end of 2022 some may prefer to stick with their employer plan for the duration of the COBRA premium benefit.
The problem with leaving a COBRA plan is that you may have already met your out of pocket maximum, so switching to a marketplace plan would cause you to start over with deductibles, says Amy OMeara Chambers, Chief Operating Officer at HealthBridge, who has worked for over 25 years in the healthcare industry. If you are under some kind of medical management with your health plan with your employer, moving to a marketplace plan isnt always convenient and can be worrisome.
What If Youre Eligible For Medicaid
Its important to understand that Medicaid eligibility is not affected by the change in how income is counted for people who are receiving unemployment compensation this year.
ARP Section 9663 temporarily adjusts the rules relating to ACA Section 36B and ARP Section 2305 temporarily adjusts the rules relating to ACA Section 1402 . In both cases, the legislative text that disregards income above 133% of FPL for 2021 is clear in noting that its for purposes of this section, meaning that the persons income above 133% of FPL would not be disregarded for other purposes, such as determining Medicaid eligibility, Basic Health Program eligibility , or whether an offer of employer-sponsored coverage is considered affordable.
If a person is eligible for Medicaid based on their regular ACA-specific modified adjusted gross income, they would continue to be eligible for Medicaid in 2021 even if theyre receiving unemployment compensation. In states that have expanded Medicaid, eligibility for adults under the age of 65 extends to 138% of the poverty level . This could potentially cause some confusion in terms of the financial assistance for which people are eligible if theyre receiving unemployment compensation in 2021. But the crux of the matter is that the externally imposed temporary income cap of 133% of the poverty level does not apply for the determination of Medicaid eligibility, whereas it does apply for the determination of premium subsidies and cost-sharing reductions.

Full Premium Subsidies + Strongest Level Of Cost
Section 9663 of the American Rescue Plan ensures that most people who receive at least one week of unemployment compensation at any time in 2021 will be able to obtain a Silver plan with $0 premiums. And Section 2305 ensures that the Silver plan will also include cost-sharing reductions that bring the actuarial value of the plan to 94% .
The Supreme Court just upheld the ACA. Should marketplace insurance buyers breathe a sigh of relief?
In both cases for determining the premium tax credit amount and cost-sharing reduction eligibility the exchange will disregard any income above 133% of the poverty level.
The enhanced premium subsidies in the American Rescue Plan result in $0 benchmark plan premiums for buyers with income up to 150% of the federal poverty level. So people receiving unemployment compensation will end up in that category, since their counted income will be capped at 133% of the poverty level.
And although there are three levels of cost-sharing reductions, the strongest which result in added benefits that make Silver plans more robust than regular Platinum plans are available to people who earn no more than 150% of FPL. Since counted income will be capped at 133% of the poverty level for people receiving unemployment compensation, all of the available Silver plans will have the strongest level of cost-sharing reductions built into their benefits.

Since the enhanced child tax credit used distribution channels the IRS developed while it was handing out stimulus checks, if youre eligible for this benefit , youre probably already benefiting in the form of advance payments in your checking account.

Consolidated Omnibus Budget Reconciliation Act
Yeah, thats a mouthful. No wonder we just call it COBRA. To put it simply, COBRA gives you the chance to extend your employer-based coverage for a limited period of time after youve stopped working for them. Big sigh of relief, right? Here are some of the upsides and downsides:
Advantages of COBRA
The good thing about COBRA is that it makes it mandatory under federal law for an employer to allow employees to pay to stay on their health care 18 months after theyve left their job. This can also stretch to 36 months if you qualify.
Disadvantages of COBRA
The not-so-great thing about COBRA is that it does mean youll pay the full cost of the health insurance premium yourself. Youll pay more than what you saw coming out of your paycheck when you were employed because your employer was subsidizing a percentage of that health care premium.
Now, if this is going to break the bank, dont worry! You can buy individual ACA health insurance instead . But its always a good idea to speak to your employer before or as soon as you leave your job to get the lowdown on what your new COBRA premium might be. That way you have all your bases covered.
What Happens if You Change Your Mind About COBRA?
Everyones allowed to change their mind. Right? A couple of months of COBRA coverage might leave you thinking that its just too expensive. Or maybe you got another job sooner than you thought you would and dont need it anymore. What now?
