A veteran may qualify for a 100% disability rating if they can provide evidence of a service-connected disability that is rated at 100% disabling. In order to qualify for IU, one way is to have a service-connected disability that renders you unable to work. This means your disability must be so severe that it prevents you from doing any kind of job, regardless of your training or experience.

In order to be considered for a 100% disability rating or individual unemployability, an individual must demonstrate that they meet the Social Security Administrations definition of disability. This definition includes a requirement that the individual is unable to engage in substantial gainful activity due to their medical condition. The SSA will also consider an individuals age, education, and work experience when making a determination.

How Does The Pact Act Affect Tdiu Benefits

The Honoring Our Promise to Address Comprehensive Toxins Act significantly expanded the number of illnesses presumed to be related to service through toxic exposure, mostly associated with burn pits and Agent Orange. However, the PACT Act did not significantly alter the VAs disability rating system, meaning it is still difficult for veterans to receive 100% disability even when they deserve it. Therefore, to obtain 100% disability benefits, many disabled veterans struggling with toxic exposure illnesses still apply for a VA total disability due to individual unemployability rating.

Thanks to TDIU, veterans who are partially disabled due to toxic exposure can still obtain maximum benefits with the help of a VA disability attorney. The Myth About Va Individual Unemployability

Most folks tell you that you have to have a single disability rated at 60%, or multiple disabilities with a total rating of 70% to qualify for VA individual unemployability.

They are not incorrect.

This form of VA individual unemployability is known as Schedular TDIU and it is covered by VA regulation 38 C.F.R. §4.16.

I call this the 60-70-40 Rule.

But there are two problems with this common perception. First, there are all sorts of rules about what constitutes a single disability rated at 60%. Can they be multiple disabilities from the same service-connected event? If so, do you add the ratings or combine them? What about disabilities affecting the same body function or paired body parts can that be a single disability? We will answer those questions elsewhere for now, I am trying to make a different point.

Can The Va Reduce My 100% Total Rating Or My Iu

To reduce your total rating, the VA has the burden to show that your service-connected condition has undergone material improvement under the ordinary conditions of life. To reduce a 100% rating based on IU, the VA must demonstrate actual employability. If the VA is attempting to reduce your rating, you are entitled to certain due process rights.

How Does Tdiu Interact With Ssdi And Regular Unemployment

Veterans can receive both Total Disability based on Individual Unemployability and SSI/SSDI benefits. While TDIU benefits are for Veterans only, Social Security Disability Insurance benefits are for both disabled Veterans and civilians who have enough work credits to qualify.

VA unemployability will only take into account disabilities that are directly connected to your service. SSDI benefits will consider any disabilities, not just those resulting from the military.

The Social Security Administration generally processes claims more much quickly and efficiently than the Department of Veterans Affairs. If you are unable to make a living, apply for both SSDI benefits and Total Disability based on Individual Unemployability. It is likely that your SSDI claim will get approved sooner, which will give you much-needed financial support while you fight a long-drawn battle for VA unemployability benefits.

Am I Still Eligible For Total Disability Individual Unemployability If Im Currently Working

If you are currently working but dont earn more than the federal poverty threshold, then the VA may consider that to be marginal employment.

If you are currently working in a protected work environment, for example, a family business, or at a job that allows specific accommodations, and your earnings are above the federal poverty threshold, you may still be entitled to TDIU benefits, because the VA does not consider a protected work environment to be substantially gainful employment.

Qualifying For Vas Individual Unemployability Benefit

VAs Individual Unemployability benefit represents somewhat of a loophole for disabled veterans in the VA system. It allows a total disability rating for compensation to be assigned to a vet when their objective disability rating is less than total according to the VA rating schedule.

The IU benefit, sometime referred to as TDIU , is based on the vets inability to maintain substantially gainful employment due to a service-connected illness or injury.

VA regulations require the vet to have at least one service-connected disability rated at 60% or more. Alternatively, if the vet has multiple disabilities, at least one must be rated at 40% or more, and in combination the vets disabilities should have a combined rating of 70% or more.

    The Pact Act And Individual Unemployability

    At VA, individual unemployability refers to the inability to hold gainful employment based on a veterans unique circumstances. Generally, veterans are unemployable if they cannot find or hold a substantial gainful employment job in an unsheltered environment.

    SGE usually means the veteran cannot work enough hours, or earn a high enough wage, to live above the poverty line. SGE could also mean an inability to find fulfilling work, but these claims are difficult to win. Sheltered environments are employers like family or veteran-owned businesses. These bosses often give disabled veterans additional time off with pay. They also offer disabled veterans other accommodations, such as more time to complete specific tasks. Accommodations such as these are often unavailable elsewhere.

    When your Individual Unemployability benefits are approved, you may also be owed VA Individual Unemployability back pay. This is money you should have been receiving back to your effective date. Your effective date can go back years it is not always the date you applied for benefits.

    What Can Va Not Take Into Consideration When Evaluating A Veteran For Tdiu

    There are certain things VA can NOT take into account when evaluating veterans for individual unemployability:

    • Non-service-connected disabilities Although a veteran may have a non-service-connected condition that prevents them from working, the VA cannot take that disability into consideration when evaluating them for TDIU the VA should only be evaluating the effect that your service-connected disabilities have on your ability to work.
    • Age For the same reason VA cannot consider non-service-connected disabilities, age cannot be taken into account when evaluating a veteran for individual unemployability. Even if the veteran has retired long ago, the operative question remains: do the veterans service-connected disabilities prevent them from working?
    • The reason that the veteran stopped working No matter the reason for leaving a prior occupation, VA cannot consider this information when evaluating a veteran for TDIU. The focus must remain on the veterans service-connected disabilities, and their impact on the veterans ability to work.

    Examples Of Veterans Who Could Pursue Tdiu Vs 100% Disability

    Example 1: Rated 70 percent for PTSD

    If youre rated 70 percent for PTSD, you meet the criteria of one disability rated 60 percent or higher. Youll be approved for TDIU if you cant hold gainful employment.

    Example 2: Rated 30 percent for right knee, 30 percent for right ankle, 20 percent for the right foot, 30 percent for asthma

    The knee, ankle, and foot ratings combine to give you a 61 percent one condition rating which meets the requirement that one condition is rated at 40 percent or higher. Your combined rating example, youll be approved for TDIU if you cant hold gainful employment.

    How Do You Qualify For A 100% Disability Rating

    A 100% disability rating is one that is granted to a veteran who is determined by the VA to be unable to work due to a service-connected disability. To qualify for a 100% rating, a veteran must provide evidence that their disability or disabilities are so severe that they are unable to perform even the most basic tasks required to live independently. The VA will also consider the severity of a veterans symptoms, as well as their ability to manage any treatments or medications related to their disability.

    There are a few steps that need to be taken to qualify for a 100% disability rating. One way is to be medically determined to be totally and permanently disabled. This can be done by the VA, your doctor, or another authorized agency. A veteran must then provide evidence that their injury or illness prevents them from performing any type of work and is service-related.

    How to Increase VA Disability Rating from 60 to 100%

    Individual unemployability is a designation that certifies a veterans medical condition as making him or her unable to work in any capacity.

    100% disability ratings and individual unemployability are both designations that the United States Department of Veterans Affairs can assign to a veterans service-connected disability.

    A 100% disability rating is the highest rating that the VA can assign and indicates that the veteran is totally disabled as a result of their service-connected disability. An individual unemployability designation means that the VA has determined that the veteran cannot work due to their service-connected disability.

    Sheltered Employment & Tdiu Benefits

    Another way that Veterans can earn an income while receiving TDIU Benefits and without breaking the VA unemployability income limits is by participating in what is called sheltered employment.

    There are many ways that your income can be considered sheltered, but 2 that are clearly identified in the regulation itself:

    1) Family business

    2) Sheltered Workshop

    Now, just because you are working for a family business doesnt mean your job is considered sheltered employment. It has to be what the regulation refers to as a protected environment.

    N.B. Veterans case law is not 100% clear on what constitutes a protected environment or sheltered employment or marginal employment for TDIU purposes. I strongly encourage that you get legal advice from an accredited VA attorney if you believe that your work is sheltered/marginal/protected so that you do not lose your TDIU benefit because you exceed the VA unemployability income limits.

    A protected environment occurs when the employer makes special accommodations to employ and provide an income for a family member or a disabled worker. This happens quite a lot a family business, to reduce its tax burden or simply to help another family member, pays a disabled Veteran family member an income that they would not otherwise be able to receive.

    How can you tell if there is a protected work environment so that you ensure your income does not get flagged as exceeding the VA unemployability income limits?

    What do I mean here?

    Va Rating For Ischemic Heart Disease

    The VA rates ischemic heart disease at 10%, 30%, 60%, or 100% depending on the severity of a veterans symptoms. Ischemic heart disease is rated under the General Rating Formula for Diseases of the Heart as follows:

    Description Rating
    Workload of 3.0 METs or less results in heart failure symptoms such as dyspnea, fatigue, angina, dizziness, or syncope, or left ventricular dysfunction with an ejection fraction of less than 30% 100%
    More than one episode of acute congestive heart failure in the past year, or workload of 3.1-5.0 METs results in results in dyspnea, fatigue, angina, dizziness, or syncope, or left ventricular dysfunction with an ejection fraction of 30% to 50% 60%
    Workload of 5.1-7.0 METs results in heart failure symptoms such as dyspnea, fatigue, angina, dizziness, or syncope or evidence of cardiac hypertrophy or dilatation confirmed by echocardiogram, electrocardiogram, or X-ray 30%
    Workload of 7.1-10.0 METs results in heart failure symptoms such as dyspnea, fatigue, angina, dizziness, or syncope or continuous medication required for control 10%

    The METs used in the VAs rating system refer to the ratio of your working metabolic rate over your resting metabolic rate. One MET is the typical amount of energy a person uses while resting. METs over 6.0 tend to be linked to more vigorous activities like running, playing a sport, or riding a bike, while activities at 3.0 METs or less include sitting, standing, or yoga.

    How much do TDIU benefits pay monthly?

    Individual unemployability benefits pay the same as a 100% VA Disability rating. Veterans who are eligible for TDIU benefits can receive more than $3,621.95 a month. There is extra compensation for veterans who have dependent children and parents.

    My TDIU appeal period is over, what now?

    If you did not appeal your TDIU benefits decision within one year, you can always re-apply. Veterans with service-connected mental and physical disabilities can apply as many times as they like.
