Let me be clear: Im not a tax professional.

This is not meant to be tax advice. All Im doing here is providing information. Im trying to give you a bigger picture view of how taxes work and how they apply to you in your delivery business as you contract with Doordash, Uber Eats, Instacart, Grubhub, Postmates or any other delivery gigs.

I really really suggest you find a tax professional who understands self employment and gig economy taxes. They can look at your specific situation and help you out.

If Im not a tax pro, why would I put out a tax guide?

Because Im in the field. Im out there delivering like you are. And Ive dealt with self employed and business taxes for a number of years.

I figured that I could find the information that answers your tax questions, and put it together in a way that applies to your delivery business. Im not a tax expert but I relied a lot on tax experts to put this all together.

Already Filed A Tax Year 2020 Tax Return

In most cases, if you already filed a 2020 tax return that includes the full amount of your unemployment compensation, the IRS will automatically determine the correct taxable amount of unemployment compensation and the correct tax. If you paid more than the correct tax amount, the IRS will either refund the overpayment or apply it to other outstanding taxes owed or other debts. The IRS began performing the corrections starting in May 2021 and continues to review tax year 2020 returns and process corrections to issue any applicable refund that is due. If the exclusion of unemployment compensation now qualifies you for deductions or credits not claimed on your original return, you should file an amended return. For example, if you did not claim the Earned Income Tax Credit on your originally filed return because your AGI was too high, and the special exclusion allowed for unemployment compensation received in tax year 2020 reduced your AGI, you should file an amended return to claim the EITC if now eligible.

Exception: If you have qualifying children and received a CP08 or CP09 notice stating you may be eligible for the Additional Child Tax Credit or Earned Income Tax Credit, you do not need to file an amended return. Instead, you can simply respond to the notice if you are eligible for the credit.

Get To Know Schedule C

While your ultimate goal may be to find another full-time or part-time job, you may take temporary jobs or self-employment to fill gaps in your income during your search. Income and expenses from self-employment are calculated on Schedule C, which is filed along with your federal income tax return. Deductions and credits differ significantly for income from self-employed workers and small business owners than for wage earners.

Depending on how long you remain unemployed, you may be able to claim tax breaks through Schedule C that would be difficult or impossible to claim as a wage earner itemizing your deductions on Schedule A. In particular, self-employed workers can claim tax breaks on health insurance premium payments without itemizing deductions. Who knows, you may decide to ditch the job search in favor of full-time self-employment.

If You Owe Tax That You Can’t Pay

If youre receiving unemployment benefits and don’t meet your tax obligations, you may end up with a lump sum of tax due when you file your return. This could create a financial hardship for you because you’re already receiving financial assistancepaying all of your taxes at once might drain your resources. For some taxpayers, this could mean deciding between paying the rent and buying groceries, or sending estimated tax payments to the IRS. If you find yourself in this situation, there are some options.

You can apply for a short-term or long-term installment agreement with the IRS to satisfy your tax debt in monthly payments. You file Form 9465 with the IRS. Form 9465 helps you determine the amount the IRS would like you to pay over a term of 72 months. However, it allows you to select lesser payments if you can justify on Form 433-F why you cannot make the payment determined on Form 9465.

You can also ask the IRS to waive any underpayment penalty thats been assessed against you if you feel it would be inequitable to require you to pay the penalty. You might also qualify for a waiver if you became disabled during the year you collected unemployment or retired during that year and were at least 62 years old.

Who Needs To File An Amended Return To Claim The Tax Break

Most taxpayers dont need to file an amended return to claim the exemption. If the IRS determines you are owed a refund on the unemployment tax break, it will automatically correct your return and send a refund without any additional action from your end.

The only reason to file an amended return is if the calculations now make you eligible for additional federal credits and deductions not already included on your original tax return, like the Additional Child Tax Credit or the Earned Income Tax Credit. If you think youre now eligible for deductions or credits based on an adjustment, the most recent IRS release has a list of people who should file an amended return.

You May Be A Victim Of Unemployment Identity Theft If You Received:

  • Mail from a government agency about an unemployment claim or payment and you did not recently file for unemployment benefits. This includes unexpected payments or debit cards and could be from any state.
  • An IRS Form 1099-G reflecting unemployment benefits you weren’t expecting. Box 1 on this form may show unemployment benefits you did not receive or an amount that exceeds your records for the unemployment benefits you did receive. The form itself may be from a state in which you did not file for benefits.
  • While you are still employed, a notice from your employer indicating that your employer received a request for information about an unemployment claim in your name.

How Taxes On Unemployment Benefits Work

You should receive a Form 1099-G from your state or the payor of your unemployment benefits early in 2022 for the unemployment income you received in 2021. The full amount of your benefits should appear in box 1 of the form. The IRS will receive a copy of your Form 1099-G as well, so it will know how much you received. You dont have to include the form when you file your federal return, but you do if your state requires it.

Unemployment benefits arent subject to Medicare or Social Security taxes, only income tax. This may help reduce your overall tax burden in the year you claim them.

When youre ready to file your tax return for 2021, write the amount stated in box 1 of your Form 1099-G on line 7 of Schedule 1, Additional Income and Adjustments to Income. You must file Schedule 1 with your Form 1040 or 1040-SR tax return. Line 7 is clearly labeled, Unemployment compensation. The total amount from the Additional Income section of Schedule 1, line 10, is then entered on line 8 of your tax return.

You must report your unemployment benefits on your tax return even if you dont receive a Form 1099-G. Go to your states website if you didn’t receive one and think you should havesome states may not mail out paper versions of the form. The form is usually available electronically, but you can also call your state unemployment office.

Reporting and investigating an incorrect or fraudulent Form 1099-G in your name will probably slow down the processing of your tax return.

    When it went into effect on March 11, 2021, the American Rescue Plan Act gave a tax break on up to $10,200 in unemployment benefits collected in tax year 2020. You had to qualify for the exclusion with a modified adjusted gross income of less than $150,000. The $150,000 limit included benefits plus any other sources of income. You claimed the exclusion when filing your 2020 tax return in the spring of 2021.

    The IRS recalculated tax returns that were filed prior to the March 2021 ruling. It then issued refunds to any taxpayers who overpaid before ARPA went into effect.

    If you collected unemployment in 2020, theres a chance you were paid benefits in January 2021 because they accrued late. This means you have to include that income in your 2021 tax return, despite the fact that the money is technically for the unemployment period in 2020. The ARPA exemption does not apply to unemployment income received in 2021. The key ARPA words are unemployment compensation paid in 2020.

  • You should contact your states unemployment insurance program as soon as possible after becoming unemployed.
  • Generally, you should file your claim with the state where you worked.
  • When you file a claim, you will be asked for certain information, such as addresses and dates of your former employment.

    Can the boss find out that you have been collecting unemployment? The short answer is sort of, but they wont get that information from the government. Theres no secret file out there with your name on it containing your entire work history and its ups and downsat least, not one that employers can access.

    The IRS views unemployment compensation as income, and it generally taxes it accordingly. You can elect to have federal income tax withheld from your unemployment compensation benefits, much like income tax would be withheld from a regular paycheck.

    Unfortunately, you dont have a choice as to how much you want to be withheld. Federal income tax is withheld from unemployment benefits at a flat rate of 10%. Depending on the number of dependents you have, this might be more or less than what an employer would have withheld from your pay.
