Do I Have To Apply For Unemployment Insurance If Im Eligible For Pua

States must establish a procedure for assessing whether PUA applicants are ineligible for regular unemployment benefits, which may or may not require filing a regular claim as a first step. To achieve this criterion, states are not required to take and process a full claim for conventional unemployment insurance benefits. Applications should be made through the states PUA application procedure, and in states where that process has not yet been established, they have to wait until it is.

What You Need To Know

  • Update 12/29/20: The federal government has extended the federal unemployment benefit programs available through the CARES Act for an additional 11 weeks. Pandemic Unemployment Assistance and Pandemic Emergency Unemployment Compensation will be available through March 14, 2021, with qualified claimants benefits fully phasing out by April 5, 2021. Federal Pandemic Unemployment Compensation benefits will resume with $300 weekly payments until March 14, 2021.

  • To receive these extended federal benefits, continue to certify weekly while unemployed. To allow your fellow New Yorkers to reach NYS DOL representatives about regular matters, please do not call to inquire about the federal program extensions at this time. As we receive additional guidance on the federal programs from US DOL, we will provide updates on our website, social media platforms, and directly via emails and texts.

  • Waiting weeks for unemployment benefits have been waived during this crisis. If youve seen the term waiting week on your payment history, it is a relic of our existing system and does NOT impact your benefits.
  • To collect regular unemployment insurance benefits, you must be ready, willing, and able to work. We understand that many of you are unable to work due to the COVID-19 pandemic and the impact of NYS on PAUSE. If you would otherwise be able to work, you should answer YES in order to receive your benefits.

What Is Considered A Valid Work Search

How to File Unemployment in Florida

Florida Department of Economic Opportunity said people are required to give good faith in their search for new work, although they are not bound to strictly apply for jobs that they think theyâre qualified for.

However, the longer a person is out of work, the more pressure theyâll face in accepting a new job.

âDuring the first 60 days a claimant collects Reemployment Assistance benefits, work will not be considered suitable if: it pays less than 90% of the claimants average weekly wage during the base period or it would require a material change in occupation for the claimant,â a spokesperson for Florida DEO told Spectrum News.

Those standards, however, change over time.

âAs the length of unemployment increases, offered work that may not have been suitable within the first few weeks of the claim may be considered suitable as prospects for desired work diminish,â DEO said. âAfter an individual has received 25 weeks or more of Reemployment Assistance benefits in a single year, suitable work is a job that pays the minimum wage and is 120% or more of the weekly benefit amount the individual is drawing. The Department will take into consideration any circumstances that compromise a claimantâs health and safety.â

Turning down a job offer could put a claimant at risk of losing benefits.

Florida Department of Economic Opportunity is making it easier for employers to report to the state people who have turned down job offers.

Ui Employee Eligibility In Florida

The state of Florida provides temporary, partial income replacement benefits and job assistance resources to unemployed workers who qualify for the program. To meet requirements for UI employee eligibility in Florida unemployment benefits, employees have to fulfill several criteria:

  • Employees must have lost their job through no fault of their own. Employees cannot qualify if they quit for personal reasons or were terminated for malicious misconduct. However, poor job performance does not disqualify them
  • Employees must be totally or partially unemployed. Partially unemployed means their hours were reduced or they are a part-time worker who cannot find additional work
  • Employees must have earned at least $3,400 before taxes in what is called the base period, which is the first four complete quarters beginning 18 months prior to their claim
  • Employees must be able to work, available to work, and actively seeking work. This includes being able to get to a job and have childcare if necessary.

Furloughed workers, or those put on mandatory unpaid leave, may also meet the criteria for UI employee eligibility in Florida. If their hours were reduced or they were put on a zero-hour schedule, workers may be eligible for unemployment benefits.

Overpayment Notice On Id Theft Claims

If you receive a Statement of Overpaid Unemployment Benefits Account for an unemployment benefits claim that you did not file, you should report the ID theft claim on TWCs online Fraud Submission portal. See Unemployment Benefits ID Theft for more information.

Once TWC confirms that a claim was filed using a stolen ID, the individual named on the claim is not responsible for any overpayment and the employers tax rate or reimbursement is not affected. Once ID theft is confirmed, any future overpayment statements will be suspended. However, you may continue to receive billing statements while the investigation is ongoing.

You do not need to respond to these statements.

It is important to promptly repay an overpayment because:

  • The overpayment stays on your claim record until you repay it in full.
  • If you apply for benefits,TWC will apply each eligible payment toward reducing your overpayment until the overpayment is repaid.
  • The Texas State Comptroller can recover your overpayment by withholding certain payments to you. That means the state cannot pay you lottery winnings, unclaimed property, unemployment benefits, or state job-related expenses, except for wages, until you repay the overpayment in full.
  • Some state funding for college students cannot be released until you repay the overpayment in full.

What Is An Offer Of Suitable Employment And How Is It Connected To Unemployment Insurance Eligibility

Most state unemployment insurance laws include language defining suitable employment. Typically, suitable employment is connected to the previous jobs wage level, type of work, and the claimants skills.

Refusing an offer of suitable employment without good cause will often disqualify individuals from continued eligibility for unemployment compensation.

For example, if an individuals former employer calls the individual back to work after having temporarily laid the individual off for reasons related to COVID-19, the individual would very likely have to accept the offer to return to work, or jeopardize his or her eligibility for unemployment insurance benefits, absent some extenuating circumstance, such as if the individual tested positive for COVID-19. The job an individual held before the spread of COVID-19 will constitute, in the vast majority of cases, suitable employment for purposes of unemployment insurance eligibility.

Example Calculation Of Florida Unemployment Benefits

Heres an example of how the calculation works under typical circumstances.

Lets assume youre applying for Florida unemployment benefits in May 2020, and you earned the following amounts during the last few quarters.

  • Q1 2019: $3,500
  • Q4 2019: $5,750
  • Q1 2020: $2,500

The base period ignores the most recent quarter, so youll disregard the income from the first quarter of 2020. Of the remaining quarters, the third quarter of 2019 was your highest-earning one. If you divide these earnings by 26, your weekly benefit amount works out to $269.23.
