In Alabama, most for-profit employers are liable for state UI taxes as soon as they have either:

  • employed one or more workers on some day in 20 or more different weeks, whether or not consecutive, during the current or preceding calendar year, or
  • paid wages of $1,500 or more in any calendar quarter during the current or preceding calendar year.

These are effectively the same rules that apply for liability under the Federal Unemployment Tax Act . In addition, if your business acquires another business that was liable for Alabama UI taxeswhich is known as successorshipyour business, too, will be liable for state UI taxes. Different rules, not covered here, apply to agricultural workers, domestic workers, and employees of some non-profit organizations.

One piece of good news is that state UI tax payments generally can be credited against your FUTA taxes.

In Alabama, UI tax reports and payments are due the last day of the month following the end of the quarter. In other words, reports and payments are due by the following dates:

  • 1st Quarter returns and payments due on or before April 30
  • 2nd Quarter returns and payments due on or before July 31
  • 3rd Quarter returns and payments due on or before October 31, and
  • 4th Quarter returns and payments due on or before January 31.

All reports and payments must be filed electronically . Use ADOLs website. You will be filing the information formerly included on paper Forms UC-CR-4 and UC-10-R. Youll make payments through the online system by Electronic Funds Transfer .

You must file quarterly returns even if your business paid no wages during a quarter. You will be subject to a penalty if you fail to file.

How Long Can I Collect Unemployment Benefits

Alabama allows unemployment benefits for between 14 and 20 weeks. The specific number of weeks you can receive benefits depends on the unemployment rate. Because the coronavirus pandemic is expected to result in widespread layoffs, it is likely that a high unemployment rate will enable workers to become eligible for benefits for the maximum 20-week period. However, even during this difficult time, there are still some jobs available and benefits end if you return to work.

The federal CARES Act would also provide all eligible workers with an additional 13 weeks of unemployment benefits, so you may be able to receive unemployment for 33 weeks total.

The average of those two quarters is $5875.00.5875.00/26 = 225.96 or rounding up $226.00. So whether your grossquarterly avg. is $6900.00 or $15000.00 both people receive the maxbenefit of $265.00 per week. This is an injustice!! If you makearound $20,500.00 a year you’ll get roughly 52% of your grossweekly pay per week, however if you make $60,000.00 a year you’llget about 23% of your gross weekly pay.

How To File A Claim For Unemployment Benefits In Alabama

Alabama To Begin Additional $300 In Weekly Unemployment Benefits

Alabama on Sept. 3 will begin paying an additional $300 per week in unemployment benefits to those who qualify, Gov. Kay Ivey and Alabama Department of Labor Secretary Fitzgerald Washington announced Thursday.

Alabama has been approved to pay for four weeks of benefits retroactively, beginning on Aug. 1 and running through August 22. Future weeks of the additional aid will be applied for on a weekly basis and are subject to approval, according to a press release from the Alabama Department of Labor.

To be eligible for the benefit, recipients must receive at least $100 in an approved Unemployment Compensation program weekly benefits and must certify that they are unemployed or partially unemployed due to the disruptions caused by COVID-19.

The Department of Labor noted that It can take up to 48 hours for payments to post to accounts, and payments could be delayed because Monday is Labor Day, a banking holiday.

Funding for the additional aid comes from FEMA disaster relief funds, and the money could run out at any time, the Alabama Department of Labor noted in the release.

Those who are eligible for the extra aid will be notified by the Alabama Department of Labor through their Tracker and through the U.S. Mail.

Do I Qualify For Unemployment Benefits

To qualify for unemployment insurance in Alabama, there are a few basic requirements you must meet. These include the following:

  • You must have earned wages in at least two quarters of your base period. A base period is defined as the first four quarters of the last five quarters, dating back from the time your claim is filed. So if you file in March 2020, your base period would be the 12 months running from October 1, 2018 to September 30, 2019
  • Your total wages during your base period must be greater than 1.5 times the amount of earnings you received in your highest quarter during your base period.
  • You must be able to work and willing to accept suitable work.
  • You must be actively looking for a full-time job.
  • Your job loss must not have been your fault.

While generally, you must be able to work in order to qualify, Alabama has different rules for workers affected by the COVID-19 pandemic. If you are in mandatory quarantine because you have or are suspected to have COVID-19 and unable to work, you will be eligible for benefits. If the novel coronavirus has caused your hours to be reduced, you may qualify so you should put in an application.

Employees who impose self-quarantines are generally not eligible because the employee is voluntarily choosing not to work.

Do You Meet The Minimum Earnings Requirement

Virtually all states look at your recent work history and earnings during a one-year “base period” to determine your eligibility for unemployment. . In Alabama, as in most states, the base period is the earliest four of the five complete calendar quarters before you filed your benefits claim. For example, if you filed your claim in November of 2021, the base period would be from October 1, 2020, through September 30, 2021.

Alabama unemployment claims top 100,000 during first week of April

Alabama employers should pay less in unemployment compensation insurance tax this year, thanks to legislation the governor signed into law Jan. 28.

Most employers should see a 29% reduction in their tax liability in 2022, Alabamas labor secretary said. These savings will hopefully allow employers to continue to hire employees and help businesses thrive, Labor Secretary Fitzgerald Washington said in a statement. The average rate will go from 1.54% to 1.10% and the per employee cost will drop from $123 to $88 for the average employer.

A $79.5 million appropriation included in Act No. 2022-1, which received unanimous approval from the Alabama Legislature in its special session, returns the Alabama Unemployment Compensation Insurance Trust Fund to almost pre-pandemic levels. The trust fund currently stands at $614 million, Washington told lawmakers. The influx of the appropriation backed by federal pandemic relief funds puts that balance at $693.5 million, close to the $697 million that was in the fund in March of 2020, he said.

I Cant Get Any Help: Alabamas Unemployment Rate Is Down But Problems With Unemployment Claims System Continue

BIRMINGHAM, Ala. Martha Moore made it through the pandemic without losing her job at a local car dealership, until the owner decided it wasnt worth it anymore and shut down.

Our business closed after about 30 years, about 2.5 weeks ago, Moore reports.

Moore had never had to file an unemployment claim in her life. After trying to get some help filing her first, she wishes shed never had to deal with this system to begin with.

Oh my God you cannot speak to a live person, Moore complains. They give you a number to call everyday at 5 p.m. and by 5:03, 600 people have already lined up. Theres no way in three minutes.

Moore says someone tried to file a fraudulent claim under her name last year while she was still happily at work, and that created an issue in getting her legitimate benefits this time. Thats why shes spent weeks calling five days a week right at 5 p.m., trying to get 1 of the 600 daily appointments with the Department of Labor for help.

I started at 4:59 p.m. like I was told at the career center, and by 5:03 they told me 600 slots had been taken for the next day, Moore says.

Were doing the best we can with the numbers we have, we just encourage them to continue trying to get through, says Alabama Dept. of Labor spokesperson Kelly Betts.

But all of those extra hands havent helped Moore yet, and her savings wont last long.

Lost Wages Assistance Program Now Complete

Alabama has completed paying out the $300 weekly payment under the LWA program, which provides supplemental payments to eligible unemployment benefits claimants who have been unemployed, partially unemployed, or unable or unavailable to work due to disruptions caused by COVID-19. They must all be getting over $100 from existing unemployment programs to qualify for this payment.

The ADOL has said they have made all 6 weeks of approved payments by the end of September, with some retroactive payments pending due to various claim issues. All payments will be retroactive to August 1st for the 6 weeks of approved funding .
