Veterans with a service-connected physical or mental disability that makes everyday tasks difficult or impossible may be eligible for VA disability benefits.
Eligibility to file a VA disability claim is dependent on meeting one of the following conditions as set by the VA:
- A Veteran who became sick or injured while serving in the military, or
- A Veteran with an illness or injury before enlisting that was worsened by service, or
- A Veteran with a service-connected disability that didn’t appear until after separating from the military

What Do I Need To Know About The Va And Social Security Programs
Both Social Security and VA pay disability benefits. However, their programs, processes, and criteria for receiving benefits are very different.
A VA compensation rating of 100% Permanent and Total does not guarantee that you will receive Social Security disability benefits. To be approved for Social Security benefits, you must meet Social Securitys definition of disability. To be found disabled:
- You must be unable to do substantial work because of your medical condition and
- Your medical condition must have lasted, or be expected to last, at least one year or to result in death.

What Is The Difference Between Unemployability And A 100% Disability Rating
The monthly compensation amount for unemployability is equal to that of a 100% disability rating. However, the qualifying criteria for unemployability is different than the requirements for a 100% disability rating.
An unemployability rating does not solely rely on the rating of a specific condition to grant benefits, it takes into account a veterans ability to work. Unemployability allows a veteran who is unable to work, to receive compensation at the 100% level even though their service-connected condition does not meet the 100% rating criteria. On the other hand, with a 100% disability rating, there are not the same restrictions on work activity as with unemployability. Therefore, if a veteran is rated 100% for their service-connected disability, and they are able to work, then they may do so.

The Impact Of Prior Tdiu Denials
Prior TDIU denials matter for a person currently applying for TDIU. The new Appeals Modernization Act has made it more difficult to reopen or file a supplemental claim for TDIU if a former servicemember has been denied in the past. This does not pertain to somebody who has been denied in the past year and is appealing the decision, as that is part of the appeals process.
A veteran who applied several years ago, failed to file an appeal, and is now attempting to reply for TDIU will have more trouble being approved. Although there is no limit to the number of times that a veteran can apply, under the AMA, new and relevant evidence is now required to file a supplemental claim for TDIU.
The good news is that a lot of things can change in a years time. New and relevant evidence may include worsening disabilities, the inability to find suitable employment, or being fired from a job due to your service-connected conditions causing interference with employment.

In the past, the answer was yes. If you were approved for VA Unemployability benefits, then your chances of getting approved for Social Security Disability benefits were very high.
Unfortunately, from 2017 onwards, the Social Security Administration changed their regulations, stating that VA Unemployability approvals would not be taken into consideration while a persons application for Social Security Disability benefits was being processed.

To qualify for total disability benefits, a veteran must be unable to maintain substantially gainful employment as a result of their service-connected disabilities. Substantially gainful employment is VAs convoluted term for determining whether the work a veteran can do meets the standards for receiving entitlement to TDIU. This includes not only how much income a person might receive in a year , but also how many hours they might work in a particular week, whether the employer has provided any accommodations, and how long a veteran has held a particular job.
The concept of maintaining employment is important because the ability to receive a job offer, or even to begin working, is different from maintaining that job for a reasonable period. This is why there are a lot of factors that VA looks at in terms of what it means to maintain substantially gainful employment. No matter what, it must only be service-connected disabilities that are considered for TDIU the effect of other disabilities that are not service-connected on maintaining substantially gainful employment is irrelevant.

Disability Ratings Are Awarded On A Case By Case Basis
To rate a disability claim, the VA first tries to determine whether or not you sustained your illness or injury in military service. Then, they assign a rating for each illness or injury.
If the VA determines your injury or illness isnt related to your military service or didnt happen while you were in the military, they will deny your claim. If the VA approves your claim, they will assign it a rating between 0% 100%.
A 0% rating shows there is an illness or injury that is connected to your military service, but it doesnt warrant compensation at this time. It is still good to get a 0% rating compared to no service-connected link because if the condition worsens at a later date, you can apply to have your disability rating upgraded.

However, survivors may be entitled to a different type of benefit called Dependency and Indemnity Compensation.
Marginal Employment & Tdiu Benefits
This is the type of income that many veterans are aware that they can receive even after being granted TDIU Benefits.
Simply go to the US Bureau of Census website, and look up the poverty threshold for one person. .
You will see that, for 2014, the poverty threshold for one person is $12,316 per year , or $11,354 . In most cases, veterans are advised that these poverty thresholds are the VA unemployability income limits.
So, this is the first way that you can earn an income and continue to receive a 100% TDIU rating without breaking the VA unemployability income limits: ensure that whatever income you make stays below the poverty thresholds for your family size.
Each year, the VA will ask you to verify your employment to determine whether you are eligible to continue to receive TDIU Benefits. They typically require that you use VA Form 21-4140 or 21-4140-1 to do this report.
The VA does cross check 2 databases that I know of: Social Security databases that record your work/income history, and IRS databases that record your family income on your annual tax returns. Word to the wise: if you are telling different income stories to different federal agencies, you are playing with fire, and may even be committing fraud.
If you indicate in this form that your income is higher than the poverty threshold, a proposal to reduce your TDIU benefits will be forthcoming.
Its one of the few times that the VA acts with a sense of purpose when they want to STOP paying you.
