Full federal support of extended benefits, as described in the CARES Act, ends on December 31, 2020. That means both the PEUC program and the PAU program benefits will expire by years end unless Congress acts.

There is broad agreement, though, that the economy is not likely to have recovered by then.

Many businesses are still reeling from the effects of the pandemic19.4 million Americans said in September that they had not worked at all, or had worked fewer hours, over the previous month because their employer closed or lost business due to the pandemic. And the unemployment rate is still hovering just under 8 percent, more than double that of a year ago.

In a paper this August, economists from the Center on Budget and Policy Priorities said the number of weeks of unemployment benefits available to workers whove lost their income may not be enough to protect millions of Americans from running out of benefits while the unemployment rate is still high.

Both political parties do agree additional relief is needed for those who have lost income because of the pandemic. So its still possible that the Pandemic Emergency Unemployment Compensation program and the Pandemic Unemployment Assistance program benefits will be extended into 2021. Theres also bipartisan support for some level of supplemental employment benefits. Its not clear yet, though, how much relief will come from Congress or when.

How Do You Appeal An Unemployment Benefit Denial In New York

If you are denied benefits for any reason, you have the right to appeal the decision by requesting a hearing in front of an impartial Administrative Law Judge of the New York Unemployment Insurance Appeal Board.

You can request a hearing online by sending a message to the state through your NY.gov account. You may also request a hearing by completing a Claimant Hearing Request Form and mailing it to: New York State Department of Labor, PO Box 15131, Albany, NY 12212-5131.

Your hearing request must be made within 30 days from the date of your determination notice. If a ruling is in your favor, you will be awarded back benefits for the period you waited for a decision. You have the right to bring an attorney to your hearing to represent you.

What Is The Difference Between Eligibility And Qualification

Eligibility involves working and earning enough money within your base period to establish a claim for benefits, and meeting the requirements of searching for work and being able and available for work. Eligibility is determined weekly. Ineligibility is a postponement of benefits until you meet the weekly requirements. Qualification involves being separated from work through no fault of your own. Disqualification is a loss of benefits. It is possible to be eligible and disqualified for benefits. It is also possible to be ineligible and qualified for benefits. You must be both qualified and eligible to receive benefits.

How Unemployment Works In Colorado

After you submit an initial claim, CDLE will request separation information from your former employers, evaluate your previous wages, and take into consideration any additional income you have received.

For some claims, the CDLE will ask for Verification of Personal Information. This request requires your signature affirming that youre a US citizen or are legally present in the country. This is an important document, and failing to return it in a timely manner could impact the timely delivery of your benefits.

You may also be asked to provide proof that you lawfully reside in the US. You can provide at least one of the following forms of identification:

  • Colorado drivers license or Colorado ID card
  • US military ID card or military dependent ID card
  • US Coast Guard Merchant Mariner card
  • Native American tribal document

    While the rules for collecting unemployment insurance vary by state, in many of them, the maximum length of time a person can collect regular benefits is 26 weeks or roughly six months. That means many people who haven’t been able to find jobs to replace ones they lost this year are now discovering that they also are losing their unemployment benefits. But three programs can help eligible individuals continue to receive crucial financial assistance, as long as they know these options exist and take action to enroll.

    Once you run out of weeks to collect benefits through your state’s regular unemployment insurance program, you become eligible for federal Pandemic Emergency Unemployment Compensation , a program that stimulus legislation created this year. When those benefits run out, you may be able to collect Extended Benefits , another federal program designed to help states during periods of high unemployment. And yet another program created by coronavirus stimulus legislation, Pandemic Unemployment Assistance , could offer you a few more weeks, once your time to collect other benefits is up.

    Coronavirus: Congress Passes $300 Per Week Unemployment Supplement

    The first program, known as Pandemic Emergency Unemployment Compensation , extends unemployment benefits by an extra 13 weeks when state unemployment payments expire.

    The second, called Pandemic Unemployment Assistance , allows the self-employed, including most gig workers and freelancers, to qualify for benefits if they meet certain criteria. Those who can’t work because they have Covid-19, are under quarantine, or are caring for a children whose school has closed due to Covid-19 are also eligible for unemployment under PUA.

    Both programs close to new claimants on March 14, 2021, and expire for existing claimants on April 5, 2021.

    How Long Can I Receive Benefits

    How you can apply for unemployment during COVID

    Workers who qualify for benefits under Texas law can receive an initial 26 weeks of benefits. If they exhaust this, there are up to 26 extra weeks available. An additional 7 weeks of benefits may be available if the unemployment rate remains high. These will be available in October at the earliest.

    On December 27, 2020, a new pandemic relief bill was signed into law. Under this legislation, unemployment benefits may be extended by up to 11 extra weeks.

    Please note that these changes will still have to be put in place by the Texas Workforce Commission. The TWC has stated that it will try to do this as quickly as possible.
