Frequently Asked Questions About 1099

GA Unemployment Tips: 1099 vs. W2

Q – My tax preparer/program requires the state ID for box 10b. What number should I use?

A – All state withholding taxes were paid to the state of Michigan. If required, enter “MI’ in box 10a, and 38-6000134 in box 10b.

Q – Why is my overpayment, which I repaid, not reported on my Form 1099-G?

A – Please refer to the back of your 1099-G RE: Restitution, Penalties and Interest – Monies repaid to the UIA during tax year 2021 are not deducted from the amount shown in Box 1. Refer to your federal 1040 instruction booklet for further information.

Q – If I repaid an overpayment during the tax year, will I have to repay the taxes that were withheld?

A – Yes, UIA paid taxes on your behalf to the federal and state taxing authority at the time your benefit payment was created or issued. Because it was determined that you were not entitled to the payment, the tax withholding paid on your behalf is also considered to have been overpaid. As a result, you must also repay UIA for the federal and state taxes paid on your behalf.

Q – Are PUA amounts included in the 1099-G?

A – Yes. Your 1099-G will include a combined total of benefits paid on any program a claimant was on including UI, PEUC, EB, PUA, TRA or DUA. This will also include additional amounts such as Pandemic Unemployment Compensation and Lost Wages Assistance .

Q – How can I get a duplicate 1099-G?

Q – I paid back part or all of the amount reported on my 1099-G, Box 2. How do I get a corrected form?

If You Owe Tax You Cant Pay

Many Americans find themselves in a position where they still need every cent of those unemployment checks for living expenses, in which case theres no money left to send to the IRS for quarterly estimated tax payments. You might still have options if this is the case.

The IRS suggests paying what you can and reaching out to take advantage of one of its payment options to deal with the balance. You can ask for an installment agreement and pay off your tax debt on balances of up to $50,000 over 72 months, according to Capelli.

Making the request is a simple matter of filing Form 9465 with the IRS. This will at least cut the 0.5% per month late-payment penalty to 0.25%, although the effective interest rate will continue at 3% .

You might also look into an offer in compromise to settle your tax debt for less than the full amount you owe, or ask the IRS for a temporary delay in collecting if your financial situation is particularly difficult. But youll almost certainly need the help of a tax professional to exercise either of these options.

Capelli strongly recommended against taking out a loan to pay your tax bill except as a last resort.

Do not, under any circumstances, borrow money unless its interest-free, Capelli said. Dont use a credit card to pay your taxes. The IRS interest rate is lower than most credit cards, and the IRS payment plan doesnt appear on your credit report.

How Taxes On Unemployment Benefits Work

Unemployment benefits are income, just like money you would have earned in a paycheck. Youll receive a Form 1099-G after the end of the year, which will report in Box 1 how much youve received in the way of benefits. The IRS will receive a copy as well.

You would have paid taxes on the full amount of your unemployment benefits if you filed your taxes before the ARPA was passed. The IRS issued a statement on March 31, 2021, urging taxpayers who had already filed not to file an amended return related to the new legislation. The IRS will recalculate and adjust all tax returns received prior to the ARPA that report unemployment income during the spring and summer of 2021 and will issue any resulting refunds.

Youll have to pay taxes on the remaining amount if you received more than $10,200 in unemployment compensation. Your 1099-G will have the information youll need to transfer to your tax return.

Unemployment compensation has its own line on Schedule 1, which accompanies your 1040 tax return. Youll transfer the amount in Box 1 of Form 1099-G to Line 7 of Schedule 1, and then the withholding amount in Box 4 of the 1099-G goes directly onto your 1040 tax return on Line 25b.

The amount that was withheld will appear in Box 4 if you asked to have income tax withheld from your benefits.

You must still report your unemployment compensation on your tax return, even if you dont receive a Form 1099-G for some reason.

If I Repaid An Overpayment Will It Be Reflected On My 1099

No. DES reports the total amount of benefits paid to you in the previous calendar year on your 1099-G, regardless of whether you repaid any overpayment. If you repaid part or all of an overpayment during the previous calendar year, you may be able to deduct the repaid amounts on your income tax return. The repaid amount should be reported on the tax return submitted for the year the repayment was made.

If Fraud Or Identity Theft Suspected Regarding Your Benefits And/or Form 1099

Will I receive a 1099G if I was a victim of identity theft?

It is the Departments goal to prevent any income that you did not receive or file for from being reported under your SSN. We are working diligently to process returned payments, debit cards, checks return a significant number of fraud calls and investigate identity theft complaints.

If you were a victim and payments were issued to you, but you returned the UC debit card, checks, or direct deposits that you received, you should NOT receive a 1099G. However, if you DO receive a 1099G and believe you shouldnt have because youve returned the funds and submitted an identity theft complaint, we ask for your patience while we work through our increased workload due to the pandemic.

If you were a victim of identity theft but no benefits were paid on the claim, you should NOT receive a 1099G. If a claim was opened and paid using your information and you did not receive the funds and therefore were unable to return them to the department, you should email the Delaware Division of Unemployment Insurance at to to file an identity theft complaint. Upon completion of the investigation, if it is found that you were a true victim of identity theft, a revised 1099G will be issued to you.

What do I do if I believe someone else filed and received UC benefit payments under my name or SSN without my permission?

  • Then you should email the Delaware Division of Unemployment Insurance at to to file an identity theft complaint.

    Effect On Other Tax Benefits

    How unemployment benefits are calculated

Taxable unemployment benefits include the extra $600 per week that was provided by the federal government in response to the coronavirus pandemic, accountant Chip Capelli, of Provincetown, Massachusetts, told The Balance.

Not only is unemployment compensation taxable, but receiving it can also affect some tax credits you might be eligible for and are counting on to defray those 2020 taxes that will be due.

Something else to consider is if you usually get the Earned Income Credit each year, Capelli said. While unemployment benefits arent considered earned income, they do influence your adjusted gross income , which is used to calculate the EIC.

The American Rescue Plan Act also expanded eligibility for the EIC to include more households, including childless households, as well as increasing the maximum credit from $543 to $1,502.
