    Problems Continue With The Department Of Labor Even After Dol Says They Made Improvements

    13 Investigates keeps hearing the same problem about the Department of Labor: you cant get anyone on the phone, even though the department says they are fully staffed.

    A man who has made dozens of calls to DOL for help about unemployment claims says he heard a different story.

    Thomas Canaday contacted 13 Investigates for help this week because he could not get anyone from DOL to answer his call.

    We told him that theyre fully staffed. However, someone at DOL told him thats not true.

    It contradicts the statement the department released two weeks ago:

    “The New York State Department of Labor remains committed to connecting unemployed New Yorkers with the assistance they need paying out more than $104 billion unemployment assistance to nearly five million people since the beginning of the pandemic. Since Governor Hochul lifted the hiring freeze, we have added more employees to assist in our call centerswhich remain fully staffed. Thanks to these efforts and continued enhancements to our online portal, answer times are now averaging about a minute and a half from the time a person enters the queuewith roughly 100,000 calls coming into The Department each week. As for factors causing people to not be able to get through on the phone, the New York State Department of Labor does not comment on speculation.”

    After we aired that statement, Canaday called 13 Investigates.

    He could not get through to anyone at the State Department of Labor.

    When Should You Contact The New York Department Of Labor Regarding Your Claim

    After filing your unemployment claim with the New York Department of Labor, you will be put on a one-week unpaid waiting period. The benefits you receive are inclusive of the waiting week. Ideally, the New York Department of Labor processes your claim within one week, and you are entitled to receive the benefits if you havent worked during the period.

    You could claim your benefits from the New York Department of Labor website with the Ny.Gov ID with which you filed your claim however, if you didnt receive your benefits, even after waiting for an unpaid period of one week. In that case, it is time for you to get in touch with the representative either by call or by visiting the NY Labor Helpdesk.

    New York May Not Repay Its Ui Debt Until 2027 Being Potentially In Debt At The Start Of The Next Recession

    New Yorks UI Trust Fund likely will return to a positive balance in 2027, based on CBCs analysis of past average UI tax rates and benefit payments, coupled with projected employment and personal income growth.21 Since New York States average economic expansion has been just under six years since 1975, the State may well enter the next recession with either a negative or low balance in its Trust Fund. This would lead to another cycle of borrowing from the federal government to meet rising UI claims.22

    Nys Department Of Labor Asks People To Give Back Overpayments

    BUFFALO, N.Y. With so many people still out of work, it came as a shock to many when they got a letter and/or an email last week from the New York State Department of Labor asking for money back.

    It turns out, some people got duplicate payments, and now the state wants that money returned.

    2 On Your Sides Kelly Dudzik did a bunch of stories about $600 mystery payments last April and May, and when the NYS Department of Labor finally got back to us, a spokesperson didnt say anything about people having to eventually give the money back.

    But on Friday, people started getting those letters and emails asking for it back, and that meant people started calling and emailing 2 On Your Side wondering if they were being scammed.

    Carly L. got both a letter in the mail and an email. She told us, The amount is $1,200 and while searching my records, I have determined must be the two mystery payments. Paying this back would create great financial hardship on me as Im making less money working 30 hours a week than most are collecting on unemployment and Im struggling to pay student loans for my bachelors degree.

    Becky S. emailed asking, Is the email and letter received truly from the Department of Labor? She also said, If it is true that you have to pay back the $600, how does the waiver apply and who is entitled to that?

    So what does that mean?

    Historic Fix To New Yorks Part

    NEW YORK, June 10, 2021 This week, New Yorks legislature and Governor Cuomo announced a historic deal to fix the states worst-in-the-nation unemployment insurance rules for part-time work that were disproportionately hurting low-and-moderate income workers, especially Black and Brown workers, and holding back New Yorks economic recovery. Senator Jessica Ramos and Assemblymember Al Stirpe championed this long overdue reform.

    Unlike in virtually all other states, New Yorks unemployment insurance rules arbitrarily and sharply reduce an individuals benefits when they return to work part-time a few hours a day spread over several days. The poorly designed policy unduly complicates decision-making by employers and workers considering a partial return to work, hurting hundreds of thousands of part-time workers across the state.

    The new pair of measures , collectively revamp New Yorks partial unemployment system so that it reduces benefits based on earnings the worker receives from part-time employment, rather than the arbitrary days-worked approach. Currently, the system disincentivizes part-time work by taking away almost all unemployment benefits when a person works just a few hours per week spread out over three or four days.

    New York Could Choose To Pay Down Its Ui Debt Or Provide Targeted Tax Relief

    While current policy will result in New York employers facing higher tax burdens until the Trust Fund debt is repaid, State lawmakers could choose to accelerate repayment of the debt and/or provide relief to businesses facing cost burdens from higher rates.

    Absent further federal action, the State has three options:

    1. Take no action and let higher taxes replenish the Trust Fund over time: Employers will continue to face elevated tax rates as the State gradually pays down its debt.

    2. Partially accelerate repayment of the debt: State resources could be used to reduce UI debt more quickly. This would require resources be diverted from other State programs and would not provide immediate tax relief to employers. However, this would reduce the time needed for New York to return to a UI positive balance, possibly allowing the Trust Fund to build up a stronger balance ahead of the next recession and reducing the risk associated with future borrowing from the federal government.

    3. Completely pay off the debt immediately: Paying off the entire debt immediately would reduce State and federal UI taxes on employers and allow the Trust Funds balance to grow more quickly before the next recession. However, this would divert significant resources from other priorities to repay UI debt, as well as shifting responsibility for UI taxes from employers to taxpayers more generally.

    Balance Remains High Despite Recovery And Increased Ui Tax Collections

    New Yorks ability to repay the federal loan is directly tied to the strength of its economic recovery and the tax rates levied on employers. State UI tax rates vary based on employers payroll, UI benefits paid to former employees and the size of the State UI fund balance. Collections of UI taxes are deposited to the States fund for the payment of benefits. Although unemployment decreased dramatically in 2021, total benefit payments remained greater than total UI tax collections, contributing to the persistently high balance in New Yorks outstanding loan.

    Fewer Unemployed Individuals, Claims and Benefits Paid

    Greater UI Tax Collections

    State UI tax rates increased in 2021 from the prior year combined with employment growth, these increases have bolstered tax collections by more than 54 percent from $2.1 billion in 2020 to $3.2 billion in 2021. These revenues are used to fund benefit payments and pay down outstanding balances.7

    New Yorks large repayments in May 2022, however, indicate greater movement towards paying down its current advance. If the overall trend of decreasing UI benefit payments continues, or such payments remain at recent levels, and UI tax collections continue to increase , New York will be able to continue taking fewer advances and making larger repayments.

    Amount And Duration Of Nys Unemployment Benefits

    The New York State Department of Labor determines your weekly unemployment benefit amount by dividing your earnings for the highest paid quarter of the base period by 26, up to a maximum of $504 per week.

    Benefits are available for up to 26 weeks. If you are still unemployed when your regular state benefits run out, you may be eligible for Emergency Unemployment Compensation and/or state extended benefits during periods of economic recession or high unemployment.     What Is A Waiver

    NYS Department of Labor Releases July Unemployment Data

    A waiver is a request to be forgiven for an overpayment of federal benefits because of an absence of fault and circumstances demonstrating that repayment would be unfair. A customer who received an overpayment of federal benefits may seek a waiver from repayment if:

  • The claimant was not at fault for the overpayment and
  • Recovery of the overpayment would be contrary to equity and good conscience.
  • What does fault mean?

    For purposes of federal waivers, a customer is at fault for a federal overpayment where DOL issued an overpayment determination finding that a willful misrepresentation was the cause of the federal benefit overpayment.

    What if I was found to be at fault?

    Under federal law, DOL cannot approve a waiver where you were found to be at fault. As a result, the determination finding you at fault for the federal benefit overpayment must be overturned before DOL can approve your waiver application. If you have not already done so, consider requesting a hearing on the determination finding you to be at fault for a federal benefit overpayment. If that determination is ultimately overturned, submit your waiver application.

    Responses By Other States

    On January 1, 2021, 18 states and territories had outstanding loans with the federal UTF as of May 31, 2022, there were seven states and territories with outstanding advances.9 On that date, loans drawn by California and New York summed to almost $25.8 billion, representing nearly 86 percent of the total balance in the United States Illinois and Massachusetts held balances of about $1.8 billion each.

    States have addressed their outstanding advances with the federal UTF by using surplus funding, issuing bonds, and modifying tax rates. In addition, the National Conference of State Legislatures notes that 20 states have used ARP Act State Fiscal Recovery Funds to repay these loans and/or replenish state UI funds.10 States that have taken such actions since September 2021 include Nevada, Ohio, Maryland, Texas and Minnesota.11

    Can I Appeal The Overpayment Determination

    If you disagree with the overpayment determination or waiver denial, you have the right to request a hearing. The hearing will be conducted by an impartial judge who is employed by the Unemployment Insurance Appeal Board. If you are present at the hearing and lose all or part of the case, you may file an appeal to the Appeal Board. If the Appeal Board does not rule in your favor, you have 30 days from the date of the Appeal Board’s decision to apply to the Appeal Board for a reconsideration of the decision, or appeal to the Appellate Division of the State Supreme Court, Third Department.

    We will not try to collect payments from you while your appeal is in progress. Any payment you made will be refunded if you are found eligible for benefits.

    State Ui Tax Rates Have Already Increased Federal Rates Will Increase Next

    NYS says critical step in unemployment process being missed

    New Yorks State UI tax rates have already increased, and federal rates will increase soon. In January 2021, the New York Department of Labor increased State UI tax rates to their highest possible levels, as required by State law. Specifically, in 2021, the minimum State rate increased from 0.6 percent to 2.1 percent , and the maximum State rate increased from 7.9 percent to 9.9 percent .16 As a result, the average State UI rate on employers increased from 2.2 percent in 2019 to 3.6 percent in 2021, an increase of 64 percent, from $292.80 to $466.80 per employee. New Yorks State UI tax rates will stay at these elevated levels until the States UI Trust Fund balance is positive.

    The federal UI tax rate will increase if New York is in debt on November 10, 2022, with employers facing a FUTA credit reduction of 0.3 percentage pointsretroactively raising the effective federal rate to 0.9 percent for 2022. Further annual 0.3 percentage point reductions will occur until the debt is paid off.17
