Liability Conditions By Business Type
General Business
General business employers are liable on:
- The first day of the calendar quarter you pay remuneration of $300 or more, – or –
- The day you obtain any or all of the business of a liable employer
Non-Profit Employers
Non-profit employers are liable:
- On the first day of the calendar quarter you pay remuneration of $1,000 or more, – or –
- As of the first day of the calendar year you employ four or more workers on at least one day in each of 20 different weeks during that year or the prior calendar year
Household Employers
Employers of household help are liable the first day of any calendar quarter you pay remuneration of $500 or more.
Agricultural Employers
Effective January 1, 2020, employers of agricultural labor are liable as of:
- The first day of any calendar quarter after January 1, 2020 in which you pay remuneration of $300 or more, – or –
- The day you obtain any or all of the business of a liable employer

Government Employers

State Labor Department Releases Preliminary November 2013 Area Unemployment Rates
The New York State Department of Labor today released preliminary local area unemployment rates for November 2013, which are calculated following procedures prescribed by the U.S. Bureau of Labor Statistics. The states unemployment rate relies in part on the results of a telephone survey of 3,100 households in New York State.
The states private sector job count increased by 141,700 from November 2012 to November 2013. As reported last week, the states unemployment rate was 7.4% in November 2013. The economy added 4,300 private sector jobs in November 2013, bringing the states job count to a record high of 7,493,500.

Business Leaders Plead With Hochul For Relief From Unemployment Costs
The New York state Capitol in Albany
ALBANY Farmers, dairy businesses and others involved in the agriculture sector say state government has a responsibility to provide relief from soaring unemployment insurance costs stemming from mismanagement by the state Department of Labor.
The agency, which is controlled by Gov. Kathy Hochul, was the subject of a scathing audit released following last months statewide elections by Comptroller Tom DiNapoli. His team of auditors determined a projected $11 billion in public funds could not be accounted for due to fraud and lax oversight of unemployment benefits managed by the Labor Department.
Labor Commissioner Roberta Reardon, first installed in the post by former Gov. Andrew Cuomo, remains in command at the agency.
Farmers and agricultural businesses cannot and should not bear the weight of replenishing the Unemployment Insurance trust fund and repaying the federal government alone, and NYSDOL should be held accountable for the negligence in overseeing the states UI system that resulted in $11 billion of fraudulent payments, a coalition of organizations that included the New York State Farm Bureau and the Northeast Dairy Producers Association said in a statement.
The coalition is urging Hochul to provide up to $3 billion to the fund, maintaining the cost of unemployment insurance for many businesses has become unaffordable.

State Unemployment Rates Based on Regression Model
Beginning with data for January 1996, unemployment rates for New York State and all other states have been estimated using time-series regression statistical models developed by the U.S. Bureau of Labor Statistics .
Advantage of Regression Model
Use of a time-series regression model reduces the month-to-month variation in unemployment rates and resident employment by reducing variation caused by sampling errors and other components of statistical noise .
Benchmarking of Estimates
Once each year, labor force estimates, such as civilian labor force and the unemployment rate, are revised to reflect updated input data including new Census Bureau populations controls, newly revised establishment jobs data and new state-level annual average data from the Current Population Survey . As part of this procedure, all state figures are reviewed, revised as necessary and then re-estimated. This process is commonly referred to as benchmarking.

The ability to share information to qualified entities has been enhanced as a result of the UI Data Sharing Bill , which amended NYS Labor Law Labor Law §537 to allow expanded access to Unemployment Insurance program data.Government agencies, including SUNY and CUNY, can now use this data for:
- evaluation of program performance including longitudinal outcome analysis
- financial or other analysis required by federal state or local law or regulation
- preparation of reports required by federal state or local law or regulation
- operation of public programs by federal, state or local governmental agencies or their agents, contractors and subcontractors for the purpose of improving the quality or delivery of program services or to create operational efficiencies
- establishment of common case management systems between federal, state or local agencies delivering or supporting workforce services for a shared customer base for the purpose of fostering workforce partnerships, program coordination, inter-agency collaboration, improving program services, or creating operational efficiencies.

The New York State Department of Labor gives Veterans priority service in all New York State employment and training programs. This priority service is guaranteed in federal law and by the New York State Veterans Bill of Rights for Employment Services. Services include career assessment, job referrals, resume preparation, job-search planning, 55-c Civil Service positions, & more.

The Hire-a-Vet Credit encourages the hire of qualified Veterans. Businesses must employ a qualified Veteran for no less than 35 hours per week for one full year. A qualified Veteran is someone who served on active duty in the US Army, Navy, Air Force, Marine Corps, Coast Guard, Reserves, National Guard, New York Guard or New York Naval Militia, and was released from active duty by general or honorable discharge after September 11, 2001. Qualified Veterans must attest that they were not employed for 35 or more hours in the previous 180 days. What You Need To Know
Important Update: As of September 5, 2021, several federal unemployment benefit programs, including PUA, PEUC, EB, and FPUC, have expired, per federal law. For more information, visit dol.ny.gov/fedexp.
- To collect regular unemployment insurance benefits, you must be ready, willing, and able to work.
- Anyone calling from DOL will verify their identity by providing: the date you filed your application and the type of claim.
- You will receive all benefits you are entitled to, including any backdated payments you are due.

If you are eligible, your first payment will generally be made in two to three weeks from the time your claim is completed and processed. In some cases, we must get additional information before payment can be made and your first payment may take longer. We use this time to review and process your application for benefits. You will not receive benefits during this period. This is why you may see your claim status as pending.
