I Feel The Same Way I Have

I feel the same way. I have no money nothing. My mom has been very sick all my life. She had a disability case pending since 2003! They told her she had a 5% chance to live. I have MULTIPLE SCLEROSIS, MAJOR DEPRESSION, MAJOR ANXIETY. I lost so much weight so to not having food to eat. I was born in this country and have payed my taxes yet I have been denied food stamps, disability, Medicaid etc. I had a social worker from a supposed nonprofit clinic tell me while I was blind in one eye IM SORRY BUT THERE IS NOTHING I CAN DO TO HELP YOU. I can& #039 t work because I& #039 m sick and I won& #039 t have a chance at my third time applying for disability but if I wait on disability which seems like next to never, I& #039 ll never survive. America is one messed up place!

When Can You Receive Both Unemployment & Long

It is unlikely that you will qualify for unemployment and disability benefits at the same time. However, there are always exceptions to the general rule.

For example, you might qualify for unemployment benefits if you are partially disabled while receiving partial long-term disability payments. Even so, it is best to talk with our long-term disability lawyer before you apply for either unemployment or long-term disability benefits.

It is more likely that you might qualify for unemployment benefits followed by long-term disability benefits or vice versa. However, the application process can be tricky. If you file a second application for benefits immediately after the termination of the other benefit, your statements from your first application could impact your second application. Again, it is best to speak with our long-term disability attorney if you believe you could qualify for both unemployment and long-term disability benefits.

Another issue that you could encounter is the termination of your long-term disability insurance coverage. If you lose your job, your employer may terminate your LTD policy. However, some LTD policies remain in effect for a short period after employment terminates.

Always Check With Your States Unemployment Office

The rules that govern unemployment benefits vary by state, so be sure to check with your stateâs unemployment office if you have any questions. Because of the increased number of people eligible for unemployment benefits, call centers could be busy and you might find yourself on hold for a long time while trying to reach a representative by phone. You can save yourself some time by finding out if your state provides an email address or a live chat service to answer questions or by seeing if they have a list of Frequently Asked Questions on their website.

Can You Claim Disability And Unemployment

As the end of their unemployment benefits nears and debate over unemployment extensions continues, some people may wonder if other options are available. Also, because the application process for Social Security Disability Insurance benefits can take many months, some people ask whether it is possible to get unemployment benefits and apply for or receive SSDI benefits at the same time.

In short, the answer is yes. However, an apparent contradiction exists in applying for or receiving both unemployment benefits and SSDI benefits concurrently because, to qualify for unemployment benefits, a person must be seeking work, while to qualify for SSDI benefits, an applicant must usually prove that he or she is not able to work.

Exceptions exist, though, for people who attempted to re-enter the workforce through the Social Security Administrations Ticket to Work Program or for people who previously worked full time but now have verifiable medical restrictions that require them to work only part time.

Should I File For Unemployment And Social Security Disability

Becoming disabled is more than just a physical problem. Unable to work due to declining health, individuals with disabilities often face financial hardships as well. While a disabled person might immediately file for Social Security Disability Insurance benefits, there is a minimum five-month wait period. Due to the vast number of disability applicants, approvals can take up to three years in some cases. Unfortunately, the financial responsibilities of life do not stop during difficult times.

Many individuals are forced to look for other means of financial assistance during this time. Some people turn to unemployment benefits as a means of support. While this may seem like a good idea, applying for unemployment can hurt a claimants ability to earn disability benefits. As the two programs serve very different purposes, applicants who apply for both may appear to be contradicting themselves.

    Unemployment Benefits Vs Ssd Benefits

Unemployment and SSD benefits serve different purposes. The primary goal of unemployment insurance is to allow an individual who lost their job and who is currently seeking future employment to receive the compensation that they need. The length of time that the individual can receive unemployment benefits, and the amount they receive, will depend upon various factors. Those factors include their occupation, the amount they made prior to termination, and whether they are actively seeking employment. Moreover, just because an individual receives unemployment benefits does not always mean they can engage in a substantial gainful activity.

On the other hand, the purpose of SSD benefits is to compensate an injured or ill worker whose medical condition prevents them from performing a substantial gainful activity . Typically, the individual cannot work at any job, or in any capacity, due to their long-term illness or injury.

In many instances, an individuals SSD benefits application is denied by the insurance company. When that happens, they may need to file an administrative appeal and attach more comprehensive medical documentation that demonstrates the extent of their permanent disability.

Unemployment And Disability: Consider The Risk Of Double Dipping

The decision to file for disability is yours, but you need to consider the potential pitfalls of taking unemployment benefits while you wait for a disability decision. In some states, you might have to repay unemployment benefits you weren’t eligible for, if Social Security later finds you were disabled during a period you collected those unemployment benefits.

Another thing to remember is that only those who are actively seeking work are entitled to unemployment benefits. If your state unemployment agency finds you aren’t genuinely trying to find work but are instead just trying to draw a check while you wait for disability benefits, you have a problem. The agency will stop your unemployment payments and force you to pay back any money you received.

In some rare cases, people can even be charged with fraud. For example, if you’re between the ages of 18 and 49, you’re considered a “younger individual” in Social Security’s eyes, and you must be unable to perform any type of work whatsoever in order to be found disabled. But if you’re collecting unemployment benefits, you’re stating that you do believe there’s work out there you can do. This conflict can be seen as fraud and can, for one, damage your credibility in your disability claim.

Receiving Both Unemployment Benefits And Social Security

In most states today, workers can collect unemployment insurance benefits at the same time that they are drawing Social Security. It wasn’t always this way, though. In the early 2000s, 20 states plus the District of Columbia had rules stating that if you received both benefits at the same time, then you would have to partially offset your unemployment benefits by as much as 50%. After Illinois repealed this requirement in 2015, Minnesota became the only state left with this provision.

Minnesotaâs offset law currently stipulates that only some residents must reduce their unemployment insurance benefits by up to 50% of their Social Security benefits. The key factors that determine whether this is necessary are the date that the resident began collecting Social Security and the length of time between that date and the date they began collecting unemployment benefits. The Minnesota Department of Revenue website has more information on this.

A person is allowed to receive unemployment benefits and federal disability benefits at the same time, but as discussed below, receiving unemployment benefits could affect a persons disability benefits in negative ways.

If you receive Supplemental Security Income benefits, any unemployment benefits you receive will reduce your SSI payment dollar-for-dollar. You have a duty to report income to the Social Security Administration if you are an SSI recipient. If the money received in a month is not spent before the first day of the next month, then it will count toward the $2,000 SSI resource limit .

If you receive Social Security Disability Insurance , unemployment benefits will not affect the amount of the SSDI payment.

When you are receiving disability benefits, the Social Security Administration will periodically conduct a review of your condition to make sure you still qualify for disability benefits. If you received unemployment benefits since the last review, that may be considered in a continuing disability review.

How Can You Receive Both Benefits At The Same Time

The Social Security Administration does not deny an individual the ability to collect both SSD benefits and Unemployment benefits. Since eligibility for unemployment benefits hinges on your ability to be ready and able to work at any given time and SSD benefit eligibility hinges on your ability not to be able to work, these two are often mutually exclusive. Exceptions do exist, however. If you attempted to re-enter the workforce through the Social Security Administrations Ticket to Work Program or if you previously worked full-time but are now only able to work part-time due to medical restrictions, you may be able to qualify for both sets of benefits.

The Ticket to Work Program is a program that lets individuals with disabilities test their ability to re-enter the workforce. Individuals have nine months to determine if they are able to work in some capacity, while still keeping their SSD benefits. If an individual worked in this program for less than 9 months but was suddenly laid off, then they may qualify for both unemployment benefits and SSD benefits.

With a qualified attorney on your side, you may be able to prove your eligibility for both types of benefits. Yet, you may face repercussions for double dipping if you are unable to make a solid case for receiving both benefits at the same time.
