File An Initial Or Weekly / Continued Claim

Welcome to the Virginia Employment Commission Workforce Services Unemployment Insurance claim filing system. In order to file for Unemployment Insurance you must have been separated from your employer or have had your hours reduced.

You should not attempt to file a Virginia claim if:

  • Your last employer was a federal civilian employer in a state other than Virginia . The only exception is if you worked as a federal civilian overseas.
  • Your employment within the last 18 months was performed in a state or states other than Virginia.

You will need the following information to file your claim:

  • Your Social Security Number
  • The accurate employer names, addresses, telephone numbers and dates of employment within the last 18 months.
  • The name and local number of your local union hall, if you obtain work through a union.
  • Your Alien Registration Number if you are not a US citizen.
  • If you have any Non-Virginia employers you must have an accurate mailing address, phone number, and dates of employment for them.
  • You will be asked to select a method of payment: VA Debit Card or Direct Deposit. If you select Direct Deposit, you will need to have your Routing Number and your Account Number .

If you do not have this information available, please gather it before you begin to file your claim. This site is available seven days a week. The filing process takes approximately 45 minutes to complete. Please allow enough time to complete this process.

Disabled Veterans And Unemployment Benefits

Disabled veterans are eligible for vocational rehabilitation benefits via the Department of Veterans Affairs Vocational Rehabilitation and Education program .

The VR& E program can help with job training and additional employment services for ex-servicemembers with qualifying disabilities.

Some VR& E training programs come with housing stipends, if you qualify, to supplement your regular unemployment insurance and UCX benefits.

If you are a disabled veteran, consider applying for a federal Civil Service Job. The federal government gives qualified disabled veterans a leg up when applying for civil service jobs, via the Civil Service points system. Many state governments provide a similar benefit for service-disabled veterans as well. So if you are an ex-servicemember with a qualifying disability, you have an advantage over other applicants when you apply for government employment.

You May Be Able To Receive Unemployment Benefits And Go To School

That doesnt mean you cant go to school far from it. But you need to be able to prove to your state that you still qualify for the unemployment benefits while you are attending school. For some states that may mean you need to show that you are seeking work. There is one more consideration some states do not allow students to receive unemployment benefits. If you are in a state which does not allow students to receive unemployment benefits, you may not be able to receive unemployment benefits while receiving GI Bill benefits.

So the best way to answer your question is to say you may be able to receive unemployment benefits while using the GI Bill, but you probably wont be able to claim 3 years of unemployment benefits while you are going to school.

Finally, you can only receive unemployment benefits while using the Montgomery GI Bill . You cannot use the Post-9/11 GI Bill and receive unemployment benefits .

How Do I Apply

You can only apply in the state where you reside, not in the state where you separated. Once you’ve finished active duty, received your DD Form 214 and completed terminal leave, then you can apply for unemployment benefits by contacting the department of labor in your state.

To apply, you will need your Social Security card, DD Form 214 and a resume. It is expected that you will be searching for employment while you are receiving unemployment compensation.

To file weekly claims by phone, call the VECs Voice Response System at 1-800-897-5630.

You will be given instructions on how to use the VRS when you apply for benefits. Follow the instructions very carefully. The instructions below apply to both Internet weekly requests for payment and VRS weekly requests for payment.

File your weekly request for payment of benefits correctly and accurately, as soon as the week has passed. You will not be paid benefits, even if you are qualified and eligible to receive them, if you fail to file your weekly request for payment.

Remember that the claim week does not end until after midnight on Saturday of the week being claimed and will not be available to you to file until after that time.

Your first weekly request for payment of benefits must be filed with the VEC after the week in which you file your application for benefits ends, but no later than 28 days after the date you filed your application.

  • They cant engage in any substantial gainful activity because of a physical or mental condition and
  • A doctor determines their condition:
  • Has lasted continuously for at least a year or
  • Will last continuously for at least a year or
  • Can lead to death

Va Individual Unemployability Benefits

If you have a service-connected disability that results in you being unable to engage in gainful employment, you may qualify for VA Individual Unemployability benefits, or IU. This can result in you getting the same benefits as someone with a 100% disability rating, even if your individual medical conditions dont add up to a 100% schedular rating. Some people refer to IU as a back door to receiving full 100% total disability benefits.

To receive this benefit, you must show that your disabilities are service-connected, and that they make it impossible for you to engage in substantial gainful employment. That is, due to your disability incurred on active-duty, you cannot gain or keep any job that would support you at least at the federal poverty level.

What Disability Judges Think About Collecting Unemployment

Disability judges usually know when youre collecting unemployment benefits because Social Security has access to unemployment benefit information and usually includes it in your claims file. Some judges do not like to see that disability applicants are collecting unemployment benefits no matter what the circumstance. Other judges will deny your disability claim only if you received unemployment after you applied for disability benefits, unless you can prove your condition medically worsened since you applied for unemployment benefits. Other judges simply will not pay you disability benefits for the time period that you were receiving unemployment . Still others dont care even if youre receiving unemployment benefits at the time of your hearing. These judges realize that people need income to live on, and that there is no guarantee that disability benefits will be granted after the long process of applying for benefits.

In addition, in many states, you can collect unemployment even if you are ony looking for part-time work. Disability applicants are allowed to work a limited amount of time, and in these states, you are you are not necessarily telling the employment department that you are available to work full time.

Unemployment Programs And Benefits Specifically For Veterans

UCX, the Unemployment Compensation for Ex-Servicemembers program, is offered by the federal government to those who are transitioning from a career in the military to civilian life. This federal program is administered by state governments. You must meet the basic eligibility rules for UCX and qualify for your states other unemployment requirements.

The applicant must:

  • Apply in the state where she resides
  • Not be on terminal leave
  • Have served the full initial term of duty or have served 180 days or more if Guard/Reserve
  • Be an active job seeker
  • Have an Honorable discharge

Eligible applicants must otherwise meet the states unemployment guidelines the continuing eligibility requirements are identical to regular unemployment claim procedures.

How much are you entitled to under this program? That depends on a number of factors including how long you served during the qualifying period, any amount of lost time that may be applicable, and other variables.

These benefits are available to veterans and non-veterans alike. Every state has its own unemployment insurance rules. But generally, state unemployment benefits are available for workers who have lost their jobs or who have had their hours reduced. In most cases, you must show that you are actively engaged in a job search, in order to continue receiving unemployment compensation.

The amount you will receive also varies by state, but there is typically a monthly or weekly cap on unemployment compensation. You can expect unemployment benefits to be much lower than the amount you were getting paid while working.

In general, no. If youre injured on the job and cannot work, you should qualify for temporary income replacement through Workers Compensation.

There are two exceptions. First, if the amount of money paid to you from your Workers Compensation benefits is less than what SDI benefits would pay, then you may make a claim for SDI to cover the difference. Second, if there is a delay in your Workers Compensation application you may apply for SDI benefits until the dispute is settled.

If your Workers Compensation claim is later approved, you will have to pay back the SDI you received so that you dont get double benefits for the same period of time. If you receive both Workers Compensation and SDI benefits for the same injury, be sure that you keep the EDD updated on your Workers Compensation claim and the Workers Compensation carrier updated on your SDI claim, so that you can avoid an overpayment.

The amount of money you receive under UCX may be reduced if you also receive any of the following:

  • Wages
  • Social Security payments
  • Workers compensation

State unemployment guidelines may also apply. There also may be other veteran-specific unemployment resources available at the state or local level be sure to look up your state and city government official site, and use that sites search tool to find veteran unemployment or military unemployment information.

Students should not, as a rule, expect full UCX benefits if they are drawing GI Bill housing allowances and in general you may find your state does not allow students to draw unemployment. Look up the rules of your state as all governments have different requirements.

Can You Get Unemployment After Leaving The Service

If you are a servicemember recently separated from active duty you may qualify for unemployment compensation if you are unable to find a new job. The Unemployment Compensation for Ex-service members program provides benefits for eligible ex-military personnel. Even though the program is based on your federal military service it is administered by your states.

You may be eligible if you:

  • Were in active duty during the base period of the claim, as established by your state.
  • Were honorably discharged.
  • Completed the first full term of service, or were discharged earlier for no fault of your own or if a reservist, you must have completed 180 days of continuous active duty.
  • You meet all other state eligibility requirements.

Receiving separation pay or retirement pay may also influence your receipt of unemployment compensation. Retirees will almost certainly receive a lesser amount since the weekly amount of retirement pay is usually “offset” against the amount of unemployment compensation.

Your state employment office handles unemployment compensation. Benefits vary from state to state. Because of this, only the office where you apply will be able to tell you the amount and duration of your entitlement.
