American Rescue Plan Act Of 2021

In an effort to align with the American Rescue Plan Act of 2021 , which excludes up to $10,200 in unemployment compensation per taxpayer paid in 2020, the IRS is sending refunds to affected taxpayers. The $10,200 is the maximum amount that can be excluded when calculating taxable income it is not the amount of refunds.

  • In addition to a refund, taxpayers affected will receive letters from the IRS, generally within 30 days of the adjustment to their federal tax return.

Why Must Some Amend Their Returns

Beginning in May and continuing into the summer, the IRS will automatically refund taxpayers who filed their returns without claiming the new tax break on unemployment benefits, it said, but this was in regards to their federal return.

Some states may still opt to tax jobless aid, tax experts say. That means some taxpayers may have to file an amended return to get their maximum refund if the unemployment tax break now makes them eligible for additional tax credits that were not claimed on their original return, or if they mistakenly excluded their unemployment income in states that choose to still tax the jobless aid.

Otherwise, the IRS said it will recalculate returns of taxpayers by incorporating the $10,200 exclusion and either refund them or apply it to other taxes they owe.

While many states will follow suit and automatically refund taxpayers, there are a handful of states that are requiring taxpayers to file an amended tax return to receive the benefit of the unemployment tax break if they filed before the American Rescue Plan was signed, says Curtis Campbell, president of TaxAct, a tax preparation software.

This varies by state. Taxpayers who filed their returns before the American Rescue Plan became law in March may need to file an amended state tax return to get a state refund.

New Mexico, for instance, has advised taxpayers to amend their returns if they were filed before mid-March.

Though the IRS will adjust already-filed tax returns to account for the new unemployment tax break, some filers may want to amend their returns anyway.

The $1.9 trillion American Rescue Plan came with a host of provisions to provide aid for the public during the pandemic, including a round of $1,400 stimulus checks. The relief package also did a few good things for workers on unemployment. Not only did it boost jobless benefits by $300 a week through early September, but it also allowed for $10,200 of unemployment income to be collected tax free.

Normally, unemployment benefits are taxable at the federal level. But this year, a number of Americans may be entitled to a tax refund on their 2020 returns due to the recent change.

However, the American Rescue Plan was signed into law after the IRS opened the 2021 tax season, so many people filed their taxes before learning about the tax break. The good news is that these filers dont have to submit an amended tax return the IRS will adjust returns accordingly so those entitled to that tax break get it. But some filers in this situation may want to amend their returns nevertheless.

Why Michigan Is Seeing A Spike In Amended State Returns

The Michigan income tax return uses the adjusted gross income from your federal return and reflects the change in rules relating to jobless benefits for 2020.

Michigans Treasury Department received around 45,000 amended state returns through late May. Thats up significantly from around 26,000 amended returns received at this time last year and about 20,000 amended returns received in 2019.

Adjusting Returns For Unemployment

Generally, unemployment compensation is taxable. But in March, the American Rescue Plan waived taxes on the first $10,200 in unemployment income, or $20,400 for a couple who both claimed the benefit, for those who made less than $150,000 in adjusted gross income in 2020 in light of the coronavirus pandemic.

Passage of the law came after some people had already filed their 2020 returns, leaving those taxpayers wondering if theyd need to submit an amended return. The IRS later confirmed it would adjust returns and automatically send refunds to eligible taxpayers.

The first of those payments went out in May. The IRS has since sent roughly 8.7 million unemployment compensation refunds totaling some $10 billion.

The agency will continue to adjust returns and send refunds through the summer, it said. It started the readjustment process with the simplest returns and is now moving through more complex ones.

Most people do not have to take any action or file an amended return to get a refund if they overpaid on unemployment compensation, according to the IRS. Some taxpayers who had their 2020 returns readjusted may not get a refund because the IRS first applied their overpayment to outstanding taxes or other debts owed at the state or federal level.

Filing Amended Returns To Report The Unemployment Exclusion In Michigan

3.11.154 Unemployment Tax Returns

The Department is requesting that all taxpayers who already filed an original 2020 Michigan tax return without reporting the unemployment exclusion now report the unemployment exclusion by filing an amended Michigan tax return. Though the Department is still exploring potential automated mechanisms regarding the unemployment exclusion, taxpayers are strongly encouraged to file an amended return to claim any refund that may be owed to them. Any information regarding an automated solution if possible will be communicated in future guidance from the Department, but there is no current timetable or certainty for this option.

An amended return reporting the unemployment exclusion will allow many taxpayers to receive an additional tax refund and allow for some other taxpayers to reduce a scheduled tax payment. Depending on the taxpayers original return, the exclusion should be reported in accordance with the following instructions:

  • Taxpayers who filed an original return and either claimed a refund or paid the tax at the time of filing.
  • Taxpayers who filed an original return resulting in tax due, but scheduled a tax payment for a future date, such as May 17, 2021.
