What Is The Difference Between A 100% Rating And Total Disability Based On Individual Unemployability

The VA assigns disability evaluations from 0% to 100% in 10% increments. Your disability rating depends on the severity of your service-connected condition. For each degree of disability, the VA has a description of the symptoms a veteran must have in order to qualify for that rating. For example, in order to receive a 50% rating for migraines, you must experience completely prostrating and prolonged attacks productive of severe economic inadaptability. When a Veteran receives a 100% rating, it means that a veteran is totally disabled due to that service-connected condition.

Total Disability based on Individual Unemployability is when a Veterans disability compensation is paid at the 100% rate even though the Veterans service-connected condition is less than the total of 100%.

% Disability Ratings & Individual Unemployability

100 VA Disability and Working (TDIU...Possible?)

Individual unemployability is a designation that certifies a veterans medical condition as making him or her unable to work in any capacity.

100% disability ratings and individual unemployability are both designations that the United States Department of Veterans Affairs can assign to a veterans service-connected disability.

A 100% disability rating is the highest rating that the VA can assign and indicates that the veteran is totally disabled as a result of their service-connected disability. An individual unemployability designation means that the VA has determined that the veteran cannot work due to their service-connected disability.

To Qualify For Tdiu You Must Meet One Of The Following Criteria:

  • You must have one service-connected disability that is rated at 60 percent or higher.
  • You must have two or more service-connected disabilities with one rated at 40 percent or higher with a combined rating of 70 percent or higher.
  • You must have a group of disabilities that relate to each other. The combined rating of this group will be considered as one disability to establish either the 60 percent or 40 percent disability rating.
  • You must be unable to secure a substantially gainful occupation that either earns above the poverty level set by the U.S. government or is outside of a sheltered working environment.
  • Your service-connected disabilities must be the primary cause for your inability to work.

This is the standard qualification criteria. However, unemployability is also considered on a case by case basis. For example, if your service-connected disabilities do not meet the TDIU rating criteria, the VA will consider other special circumstances unique to your case to determine entitlement of full benefits. The VA also considers whether a non-military person with a similar vocational and educational background as yours would be unemployable if in your situation.

Ssdi And Va Disability How Do They Compare

3 Ways to Get an Individual Unemployability (TDIU) VA Rating

Social Security and the U.S. Department of Veterans Affairs pay disability benefits to eligible people and their qualified dependents. However, the programs, processes, and criteria for receiving benefits are very different. Each agency must follow its own definition and requirements.

See the fact sheet for a side-by-side comparison of the differences between SSDI and VA compensation.

Disability Criteria SSDI
Injury/Illness must be due to military service
Impairment must prevent the ability to work at substantial gainful activity level at time of application
Disabling condition must last at least 12 months or end in death
Age, education, and work history can affect eligibility
Monthly benefit amount and eligibility are not affected by the other program
Offers partial payments based on scale of disability
All or nothing disability payment

Social Security pays disability benefits to people who cant work because they have a severe medical condition that is expected to last at least one year or result in death. Federal law requires this very strict definition of disability. While some programs give money to people with a partial disability or a short-term disability, we do not.

The VA pays disability compensation to veterans who have a service-connected disability resulting from a condition that was incurred during or aggravated by active military service.

The Role Of Substantially Gainful Unemployment Receiving Tdiu Benefits

To qualify for total disability benefits, a veteran must be unable to maintain substantially gainful employment as a result of their service-connected disabilities. Substantially gainful employment is VAs convoluted term for determining whether the work a veteran can do meets the standards for receiving entitlement to TDIU. This includes not only how much income a person might receive in a year , but also how many hours they might work in a particular week, whether the employer has provided any accommodations, and how long a veteran has held a particular job.

The concept of maintaining employment is important because the ability to receive a job offer, or even to begin working, is different from maintaining that job for a reasonable period. This is why there are a lot of factors that VA looks at in terms of what it means to maintain substantially gainful employment. No matter what, it must only be service-connected disabilities that are considered for TDIU the effect of other disabilities that are not service-connected on maintaining substantially gainful employment is irrelevant.

Tdiu May Not Be A Permanent Benefit

Although not typical, the VA may require that you undergo periodic medical examinations to verify whether or not you are still unable to work because of your service-connected disabilities.

Likewise, the VA will want to know if you do get a steady job. Should you reenter the workforce and maintain your job at a significant level for 12 months the VA will review your ability to work to determine if your TDIU benefit should be discontinued. Or, your benefit may simply be reduced down to the level of your actual combined disability rating. Generally, this review process does not result in any overpayments of compensation benefits.

While you are receiving full TDIU benefits you can also pursue educational and vocational training to help you overcome your disabilities so that you can work.

The VA wants to know all about your education and vocational training. The VA is going to consider your background and how that affects your chances of being employable. This is a reason our veterans disability benefits lawyers work with vocational experts to obtain reports for clients. A vocational expert can write a report about how your service-connected disabilities prevent you from doing your old profession.

For example, if you have neuropathy from Agent Orange exposure and you were an HVAC technician, you may not be able to grasp the mechanical items you need to do the job. Another example would be if you have service-connected schizophrenia and were a school teacher. It is likely your schizophrenia can prevent you from working with small children.

We see very few veterans that are attending school full-time receive Individual Unemployability benefits. Going to school full-time is an indicator to the VA that you intend on having a career after school. If you are just attending a few classes here and there with no intention of completing a degree, explain that in the remarks section.
